RESOLUTTON 08'18729 A RESOLUTION PURSUANT TO BILLINGS, MONTANA CITY CODE, ARTICLE 22-900: SALE, DISPOSAL OR LEASE OF CITY PROPERTY, DESCRIBING THE PROPERTY TO BE SOLD, DECLARING THE INTENT OF THE CITY TO DISPOSE OF THE PROPERTY AND AUTHORIZING CITY OFFICIALS TO PROCEED, WHEREAS, the City of Billings finds it necessary or desirable to dispose of property it currently owns, located on ShÍloh Road in the City of Billings, Yellowstone County, Montana, as follows; Parcel No. 22 on Montana Department of Transportation Project MT 1031(4), as shown on the Right of Way plan for said project recorded in the office of the County Clerk and Recorder of Yellowstone County, Montana, Said parcelis also described as tracts of land inE%NE% of Section 15;and theSÊ%SE% of Section 3, Township'1 South, Range 25 East, Yellowstone County, Montana, as shown by the shaded areas on the plat, consisting of 5 sheets, attached hereto and made a part hereof, contalning a total area of 0,668 ha (1,65 acres), more or less. Parcel No. 25 on Montana Department of Transporlation Project MT 1031(4), as shown on the Right of Way plan for said project recorded in the office of the County Çlerk and Recorder of Yellowstone County, Montana, Said parcel is also described as tracts of land in Ann Ross Park, Block I and Ann Ross Park, Block 4 of the plat of the Village Subdivislon, in the City of Billings, according to the official plat on file in the office of the Clerk and Recorder of Yellowstone County, Montana, undei Document No.'3324330, as shown by the shaded areas on the plat, consisting of 3 sheets, attached hereto and made a part hereof, containing an area ol 0.228 ha (0,56 acre), more or less. Parcel No, 31 on Montana Depaftment of Transporlation Project MT 1031(4), as shown on the Right-of-Way plan for said project recorded in the offlce of the County Clerk and Recorder of Yellowstone County, Montana. Said parcel is also described as a tract of land in the Park in Block 16 of the Olympic Park Subdivision in the City of Billings, Montana, according to the offlcial plat thereof, recorded under Document No. 1140076, in the office of the Clerk and Recorder of Yellowstone County, Montana, as shown by the shaded area on the p^lat, consisting of 2 sheets, attached hereto and made a part hereof, containing an area o'(272 m' (2,928 sq, ft,), more or less, Parcel No. 83 on Montana Depaftment of Transportation Project MT 1031(4), as shown on the Right-of-Way plan for said project recorded In the office of the County Clerk and Recorder of Yellowstone County, Montana. Said parcel is also described as a tract of land in a Park located in Mlssions United Subdlvision, in the City of Billings, Montana, according to the officlal plat thereof, on file and of record in the office of the Clerk and Recorder of Yellowstone County, Montana, under Document No. 3135018, as shown by the shaded area on the plat, consisting of 1 sheet, attached hereto and made a part hereof, containing an area of 122 mz (1,313 sq, ft,), more-orless. WHEREAS, 22-900 BMCC requires the city to declare its intentlon to dispose of such lands, giving the public the oppoÉunity to be heard regarding such action, and setting a public hearing date, and WHEREAS, Article 22-900 BMCC also requires that all property owners within three hundred (300) feet of the exterior boundaries of said property, be notified by mail, fifteen (15) days in advance of the time, date, place of public hearing and the existing and proposed use. ---PAGE BREAK--- NOW, THEREFORE, BE IT RËSOLVED BY THE CITY COUNCIL OF THE CITY OF BILLING, MONTANA, AS FOLLOWS: PUBLIC HEARING. The public hearing date has been set for July 14,2008, at 6:30 o'clock p,m, in the Council Chambers, located on the Second Floor of the Police Facility, 220 Nofth 27'n Street, Billings, Montana. The Clty Clerk is hereby dlrected to notice of the public hearing in The Billings Times in its regular issue on June 26tn and July 3'q, 2008, and to mail a copy of such notice to all property owners within the three hundred (300)foot notification area, APPROVED AND PASSED by the City Council of the City of Billings this 23rd day of June, 2008, THE CITY OF BILLINGS: ATTEST: CARI MARTIN; CITY CLERK
