RESOLUTION 09-18831 A RESOLUTION LEVYING AND ASSESSING ALL PROPERry IN CERTAIN LIGHTING MAINTENANCE DISTRICTS WITHIN THE CITY OF BILLINGS, PROVIDiNG FORNOTICE, HEARING AND ADOPTION. WHEREAS, certain iighting maintenance districts have been created within the City of Billings, and WHEREAS, State Law provides for assessment for maintenance costs annually, and WHEREAS, M.C.A. 7-12-4332 provides that the City shall pass a resolution levyng and assessing malntenance cosls. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BILLINGS. MONTANA, AS FOLLOWS: 1. DISTzuCTS AND ASSESSMENTS. The lighting maintenance districts and assessments to defray one hundred percent (1 00%) of all the costs ofmaintenance and lighting are hereby levied and assessed as listed and described on E)GIIBIT attached hereto and by this reference said exhibit is made a part hereof. 2. PERIODOF ASSESSMENT. That said assessment is to defray costs for the fiscal year 2010. 3. DISPOSITION OF COLLECTIONS. That the assessments as collected shalt be placed in the respective lighting maintenance fuqds and shall be used to defraythe costs of maintenance and lighting as provided by law. 4. NOTICE OF HEARING. On Monday, June 8, 2009, at 6:30 o'clock p.m., or as soon thereafter as the matter may be considered on the agenda in the Cor¡ncil Chambers of City Hail, Billings, Montana, the City Council will hear objections to the adoption ofthis resolution. The City Clerk is hereby directed to publish notice thereof twice, at least five days prior to the hearing, in the Billines Tirnes. 5. EFFECTIVE DATE. This resolution shall be eflective upon adoption.
