ORDINANCE NO. 05-5344 AN EMERGENCY ORDINANCE OF THE CITY OF BILLINGS AMENDING SECTION 24-411, BMCC, TO ALLOW MOTOR VEHICLE PARKING FOR CAMPING PURPOSES FOR CERTAIN SPECIAL EVENTS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BILLINGS, MONTANA: Whereas, Section 24-411, BMCC, Parking for camping purposes, makes it illegal to park any motor vehicles for camping purposes in the city, except in an authorized trailer park. Whereas, the Loyal Order of Moose Billings Lodge No. 558 has requested a temporary exemption from the ordinance to allow overnight campers to park at the Moose Lodge at 131 Calhoun Lane from September 15th through 19th, 2005, in conjunction with the State Moose Convention, an event held on a rotating basis at Moose Lodges throughout the state of Montana. Whereas, the Al Bedoo Temple of Shriners has requested a temporary exemption from the ordinance to allow overnight campers to park at the Shrine Auditorium at 1125 Broadwater Avenue from October 6th through 9th, 2005, in conjunction with the annual Shrine Polka Festival. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BILLINGS, MONTANA, AS FOLLOWS: Section 1. TEMPORARY EXEMPTIONS. Section 24-411, BMCC, is hereby amended to allow a temporary exemption from the prohibition against parking motor vehicles for camping purposes in the city from September 15th through 19th, 2005, at the Moose Lodge, 131 Calhoun Lane, and from October 6th through 9th, 2005, at the Shrine Auditorium, 1125 Broadwater avenue, solely for the purposes of certain events to be held at those facilities. Section 2. WAIVER OF SECOND READING. As ALLOWED BY Section 7-5-104, MCA, and Section 2-235, BMCC, the City Council specifically waives the second reading of this emergency ordinance. Section 3. VOTE REQUIRED. As required by Section 7-5-104, MCA, and Section 2- 235, BMCC, this emergency ordinance is passed with at least a two-thirds vote of the whole City Council for passage. Section 4. EFECTIVE DATE. This ordinance is effective immediately upon passage and approval, and shall remain effective for no more than ninety (90) days. ---PAGE BREAK--- Section 5. SEVERABILITY. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect the other provisions of this ordinance, which may be given effect without the invalid provisions or application and, to this end, the provisions of this ordinance are declared to be severable.
