RESOLUTTON NO. 09-ì 8782 A RESOLUTION RELATING TO W.O. 08-02, MISCELLANEOUS/DEVELOPER-RELATED IMPROVEMENTS; DECLARING IT TO BE THE INTENTION OF THE CITY COUNCIL TO ORDER IN THE PROGRAM FOR THE PURPOSE OF UNDERTAKING CERTAIN LOCAL IMPROVEMENTS AND FINANCING THE COSTS THEREOF AND INCIDENTAL.THERETO THROUGH THE ISSUANCE OF SIDEWALK, CURB AND GUTTER IMPROVEMENT BONDS SECURED BY THE CITY'S SPECIAL IMPROVEMENT DISTRICT REVOLVING FUND. The overoge tofol ossessmeni, including engineering, odministrotive, ond bond costs is eslîmoled to be $l ,874,with o high of $ló,80ó, low of $0.00, ond o medion of $7 64. PERIOD OF ASSESSMENT. The ossessmenls for oll improvements ond costs sholl be poid in nol more thon twelve (12) onnuol insfollments, plus inierest, provided however, thot poyment of one-holf of eoch onnuol inslollment, plus inleresT, moy be deferred to Moy 3l of the yeor following the ossessment. PROPERTY OWNER OPTION TO CONSTRUCT IMPROVEMENTS. In the evenl fhol lhe Cily Council orders in lhe obove-described Ìmprovements following the public heoring, then the owners of oll properties to be ossessed for the costs of soid improvements will be notified of such ociion in writing. Soid owners will hove lhiriy (30) doys from the dole of soid nolice in which 1o install the required improvements oi lheir own expense. In the event the owners do not insloll these improvements, lhe City will do so ond will cssess the cosls ogoinst the benefifed propertÌes os described herein. 5. 6. Z. METHOD OF FINANCING; PLEDGE OF REVOLVING FUND; FINDINGS AND DETERMINATIONS. The City will issue Sidewqlk, Curb, qnd Gulfer lmprovemenl Bonds in on oggregcte principol omounl not to exceed $32ó,000 in order to finonce the costs of the lmprovements. Principol of ond inferest on lhe Bonds will be poid from speciol ossessmenis levied ogoinst lhe property in the Project. This Council further finds it is in the public inferest, ond in the best inlerest of the Cily ond the ProjecT, lo secure poymeni of principol of ond interesl on the Bonds by the Revolving Fund ond hereby ouÌhorizes lhe Cily to enter into lhe underiokings ond ogreements outhorized in Secïion 7- l2-4225 in respecf to the Bonds ln determining to outhorize such underlokings ond ogreements, this Council hos ioken info considerolion lhe following foclors: Esiimoled Morkel Volue of Porcels. The Public Benefit of lhe lmorovements. Cunenf City Subdivision ond Site Development Ordinonces, ond under Cily Council policies, the cosl of instollotion of new curb, gulter, sidewolk, ond drive opprooches is io be borne by ihe odjoining properiy owners. Some of the porcels hove been involved in recent construclion or subdivision octivity. Some of these porcels hove undergone recent sife developments, both resideniiol ond commerciol, in which o permil wos lqken oui, buf the improvements were not consTructed, or lhe developer hos requesied thoi the improvements be included ond conslrucied under the proposed project. Developers generolly moke o requesl lo be included in the proposed projecl to toke odvontoge of fhe finoncing opporlunity of the 12-yeor ossessmenl. Some of these porcels ore lots included in recenlly opproved subdivisions. The improvemenfs were required os porl of the Subdivision lmprovements Agreements, but were not inslolled by the subdivider/developer. The remoining porcels represent o coniinuoiion of on onnuol improvemenl projecl for repoirs of tripping hozords, deterioroled sidewolks, droinoge problems, property owner requesls ond citizen comploints. The project improvemenls ore locoted in vorious Tosk Force oreqs, both commerciol ond residentiol, throughout lhe City. REIMBURSEMENT EXPENDITURES. Requlalions. The Uniled Sfotes Deportment of Treosury hos promulgoted finol regulotions governing the use of proceeds of tox-exempt bonds, oll or q portion of which ore to be used to reimburse The City for project expenditures poid by the City prior to lhe dole of issuonce of such bonds. Those reguloiions (Treosury Regulolions, Secfion 1.150-2) (the "Regulolions") require thot the Cily odopt o stclement of officiol inlent lo reimburse on originol expendilure not loter ihon ó0 doys ofter poyment of Ihe originol expendiiure. The Regulolions olso generolly require thol lhe bonds be issued ond the reimbursement qllocotion mode from the proceeds of the bonds within I I months (or fhree yeors, if fhe reimbursement bond issue quolifies for fhe "smoll issuer" exception from the orbitroge rebote requirement) ofter the lofer of the dole the expendilure is poid or (ii) the dote the project is ploced in service or obondoned, buf (unless the issue quolifies for the "smoll issuer" exceplion from ihe orbitroge rebote requirement) in no event more thon three yeors ofter fhe dote the expendiTure is poid. The Regulotions generolly permil reimbursemenl of copitol expendilures ond cosfs of issuonce of the bonds. Prior Expendilures. Olher lhon expenditures to be poid or reimbursed from sources olher ihon the Bonds, (ii) expenditures permilted lo be reimbursed under the tronsitionol provision conloined in Section 1.150-2fi)(2) of lhe Regulolions, Iili) expenditures constituling preliminory expenditures within the meoning of Seciion ,ì.150-2(f){2) of the Regulolions, or (iv) expendilures in o "de minimus" omount (os defined in Section 1.150- 2(f)(l ) of the Regulotions), no expenditures for the lmprovements hove been poid by the City before the dqte ó0 doys before ihe dqte of odoption of this resolution. Declorslion of Inienl. The City reosonobly expects to reimburse the expendilures mode for cosis of the lmprovements out of lhe proceeds of Bonds in on esfimoted moximum oggregote princìpol omounl of $32ó,000 ofler lhe dqte of poyment of oll or o porlion of the costs of the lmprovements. All reimbursed expenditures sholl be copitol expendifures, o cosl of issuonce of the Bonds or other expenditures eligible for reimbursement under Section ì .I 50-2[d)(3) of the Regulotions. ---PAGE BREAK--- Budoelorv Matters. As of fhe dole hereof, there ore no City funds reserved, ollocoted on o long-term bosis or olherwise sei oside (or reosonobly expected 1o be reserveo, cllocoted on o long-term bosis or olherwise sef oside) lo provide permonent finoncing for the expenditures reloled to the lmprovements, other fhon pursuont to the issuonce of the Bonds. Reimbursement Allocotions. The City's finonciol officer sholl be responsible for moking the "reimbursement ollocotions" described in the Regulotions, being generolly rne lronsfer of the opproprioie omount of proceeds of lhe Bonds to reimburse fhe source of temporory finoncing used by Íhe City to mqke prior poyment of the costs of the lmprovemenfs.
