RESOLUTION NO. 09-1 8843 A RESOLUTION EXPANDING BILLINGS DOWNTOWN BUSINESS IMPROVEMENT DISTRICT NO. OOO1 FOR THE PURPOSE OF PROVIDING AND MAINTAINING THE COMMON AREA IMPROVEMENTS AND OTHER PORTIONS OF IMPROVEMENTS MADE INDOWNTOWN. CITY OF BILLINGS. MONTANA WHEREAS, the Downtown Business Improvement District No. 0001 was created by the Billings City Council on August 22,2005; and WHEREAS, on May 4,2009 the City received a petition from MET Transit to expand the boundaries of the BID to include its property at the intersection of 2no Avenue North and N. 25t'' Street; and WHEREAS, the City Council adopted a resolution of intent to expand the on May 26, 2009, advertised its intent to expand the district and conducted a public hearing on June 22,2009 regarding the proposed expansion; therefore BE IT RESOLVED by the City Council of the City of Billings (the "City"), Montana, as follows: Section 1. Expansion of Business Improvement District No.0001: In accordance with the Resolution of Intent No. 09-18817, the City Council hereby expands the Downtown Business Improvernent District (B.LD.) No. 0001. The expanded boundaries are as displayed on Exhibit A attached hereto. The expansion property is described as; Lots 1-12, Block 60, Billings Original Townsite, in the City of Billings, Yellowstone County, Montana according to the official plat thereof on f,rle and of record in the office of Clerk and Recorder of said county, under Document No. 016312. The described property is subject to and wìll benefit from all assessments, improvements, selvices, govemarlce and other activities that are provided to and for the preexisting balance ofthe District. Section2. DurationofDistrict. ThedurationoftheB.I.D.shallbeforaperiodof l0yearsfiornthe date of its formation (August 22,2005) as prescribed in Section 7-12-1141 M.C.A.
