1 RESOLUTION NO. 02-17804 A RESOLUTION OF THE CITY OF BILLINGS, MONTANA, REVOKING RESOLUTION NO. 01-17710 WHICH DISCONTINUED AND VACATED a portion of South 31st Street West between Drive and Rosebud Drive in Lampman Subdivision WHICH RESOLUTION WAS ADOPTED ON JUNE 11, 2001 WHEREAS, a proper petition was filed with the City Council of the City of Billings, Montana, as per Section 22-601 BMCC, requesting discontinuance and vacation of a portion of South 31st Street West between Drive and Rosebud Drive in Lampman Subdivision as described hereinafter; and WHEREAS, a public hearing was properly noticed and held as required by law; and WHEREAS, on June 11, 2001, the City Council of the City of Billings, Montana passed Resolution No. 01-17710 discontinuing and vacating a portion of South 31st Street West between Drive and Rosebud Drive in Lampman Subdivision; and WHEREAS, the vacation of the described land was subject to the condition, inter alia, that the City of Billings would be reimbursed for the discontinuance and vacation of the land described in Resolution No. 01-17710 at an agreed upon unit price/square foot, based on comparable prices provided to the Engineering Department; and WHEREAS, one of the owners of the lots abutting the block of South 31st Street West which was to be vacated pursuant to said Resolution has refused to agree to said condition; and ---PAGE BREAK--- RESOLUTION NO. 02- 2 WHEREAS, in view of the facts and circumstances as set forth above, it is now the intention of the City Council of the City of Billings, Montana to revoke Resolution No. 01-17710. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BILLINGS, MONTANA, AS FOLLOWS: REVOCATION OF RESOLUTION NO. 01-17710. Resolution No. 01-17710, passed by the City Council of the City of Billings, Montana on June 11, 2001 is hereby revoked. PASSED by the City Council and APPROVED this 11th day of February, 2002.
