RESOLUTION NO. 0&18671 A RBSOLUTION OF THE CITY OF BILLINGS APPROVING PETITIONS FOR ANMXATION ANÞ ANNÐSNG TERRITORY TO THE CITY. WHEREAS, one hundred percent (100%) of the ûeeholders who constitute more than fifty percent (50%) of the resident &eeholder electors have petitioned ttre City for annexation of the tenitory hereinafter dascribed; and WHEREAS, the tenitory wæ described in the petition as required by law, and WHEREAS, arurexation of said territory would be in the best intøest of ttre City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COI.INCIL OF THE CITY OF BILLINGS. MONTANA, AS FOLLOWS: 1' TERRITORY ANNEXED. Pursuant to Pçtition filed as provided M,C,A,, Title 7, Chaprer Z, Paú 46, the following tenitory is hereby annexed to the City of Billings: A tract of land situated in the E l/2 of Section 16, and tbe NW l/4 qf Section 15, T,lS., R.268,, p.M.M., Yellowstonc County, Montana, more particularly described as: Tract2-B'l of AmendedTracts2-Aand2-B,of Amended Tract2,Certifîcateof SurveyNo, ll2l,Recorded January 14,2008, Under Document No. 345l343,Records of Yellowstone County, Montana, IacIudingalladjacentright.of'wayofFentonAvenueSouthwest, Said Tract containing 54.691 gross acres andS3,6}4net acres. 08-02) See Exhibit Artached 2. CONDITONS. The annexation is approved, subject to the following conditions: a. Prior to site.development a Development Agreement shall be çxecuted between the owner(s) and the City that shall stipulate specific infrastructure improvements and provide guarantees for said improvements; or b. A Subdivision Improvements Agreement (SIA) and Waiver of Right to Protest the Creation of SIDs shall be approved and filed that will stipulate specific infrastructure improvements and provide guarantees for such infrastructue improvçments, The subdivider will be responsible for forming a Park Maintenance District at the time of subdivision. 3' PROCEDURE' All procedures as required under M,C.A., Title 7, Chaptø 2, Pa:t 46,have been duly and properly followed and taken.
