PETITION FOR ANNEXATION TO THE CITY OF BILLINGS NOTICE TO PETITIONER This is a Petition to the City of Billings requesting the annexation of property to the City, pursuant to MCA Title 7, Chapter 2, Part 46. Procedures for annexation are governed by the Statutes of the State of Montana. This Petition requires the signatures of more than 50% of the Resident Freeholder Electors to be considered for annexation. INSTRUCTIONS 1. All items must be completed or provided. Please type or print. You may attach additional pages if more space is needed. 2. Prepare a map drawn to a scale adequate and legible to show the property requesting annexation and all other property within one-quarter (1/4) mile. The map must show: a. The present and proposed boundaries of the municipality; b. The present streets, major trunk water mains and sewer mains; c. The zoning of the property requesting annexation and the property immediately adjacent to it. 3. Prepare a full legal description or meets and bounds of the area to be annexed, including adjacent Rights-of-Way, as well as a visual exhibit of said legal description. 4. The Petition should be submitted to the Planning Department, Monday through Friday between the hours of 8:00 a.m. and 5:00 p.m., located on the 4th Floor of the Miller Building at 2825 3rd Ave North, Billings, Montana. Upon presentation, the Petition will be checked for completeness. Once accepted, the Petition will be routed to the following City Departments: Public Works, City- County Planning, Public Utilities, Fire Department, City Attorney, Police Department, and Finance Department. If no problems with the Petition have been noted by the departments, the City Clerk will schedule the Petition for City Council action. 5. By filing the petition for annexation, the Petitioner(s) agree that only those City services which are available to the general area shall be provided to Petitioner, and that additional services as may become available to the general area shall be made available to Petitioner(s) in the same manner as said services are made available to other residents of the City. Petitioner(s) specifically waive the right to the report and plans for extension of services as provided in MCA Title 7, Chapter 2, Part 47. 6. A description of the territory to be annexed to the City is legally described on a document attached hereto.
