RESOLUTION 05-18257 A RESOLUTION OF THE CITY OF BILLINGS, MONTANA, DISCONTINUING AND VACATING the Street Bulb portion of Indian Trail . WHEREAS, a proper petition was filed with the City Council of the City of Billings, Montana, as per Section 22-601 BMCC, requesting discontinuance and vacation of the Street Bulb portion of Indian Trail as described hereinafter; and WHEREAS, a public hearing was properly noticed and held as required by law. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BILLINGS, MONTANA, AS FOLLOWS: 1. DISCONTINUANCE AND VACATION. Pursuant to Sections 7-14-4114 and 7-14- 4115, M.C.A. the Street Bulb portion of Indian Trail more particularly described as follows: A tract of land situated in the NW 1/4, Section 28, T.1.N., R.26E., P.M.M., being more particularly described as follows: Beginning at the northeast corner of Lot 7, Block 1 of the Amended Plat of Block 1 & 10 and Portions of Blocks 7 & 8, Spring Valley Subdivision. Said point of beginning, lying on the westerly right-of-way line of Indian Trail; thence, from said point of beginning along a non-tangent curve to the right a distance of 235.63 feet (curve radius: 75.00 feet, curve delta 180°, chord bearing N01°33'00"E, chord length 150.00 feet); thence along said chord 501°33'00'W a distance of 150.00 feet to the point of beginning. Said right-of-way tract having an area of 8,836 square feet, more or less. Is hereby discontinued, abandoned and vacated. 2. PUBLIC INTEREST. The discontinuance, vacation and abandonment of the above described Street Bulb portion of Indian Trail is in the best interest of the public and can be done without any public detriment.
