i ,iu * ÐJJ' RESOLtnON 08-18667 A RESOLUTION PURSUANT TO BILLINGS, MONTANA CIry CODE, ARTICLE 22.900: SALE, DISPOSAL OR LEASE OF CITY PROPERTY, DESCRIBING THE PROPERTY TO BE DISPOSED OF, AI.ITHORTZING CITY OFFICIALS TO PROCEED ANÞ IMTIATING REZONING THE PROPERTY. WHEREAS, the Çity of Billings owns and desires to dispose of unnecessary public property located at approximately 5400 Southgate Drive; and WHEREAS, the public property to be disposed of is more parficularly described as follows: A portion of I¡t l5A" Block 2, Southgate Subdivisior¡, First Filing City of Billings, Yellowstone County, Montana, according to the official plat now ott ãi" anä of record in the ofEce of the Clerk and Recordcr of Yellowstone County, Montana and as show on the attached exhibit A; and WHEREAS, the notice required by Section 22-gO2 of the Billings Mont¿na Cþ Code has been duly published and mailed; and WHEREAS. the publio hearing required by Section 22-go2 of the Billings, Montana City Code was duly held on the 14ú dayofJanuary, 2008. NOW THEREFORE BE ru RESOLVED BY THE CITY COUNCIL OF THE CITY OF BILLINGS, MONTANA AS FOLLOWS: 1) That the City staff is authorized to proceed with the sale of a portion of Lot l5A, Block 2 of the Southgate Subdivision, First Filing, measuring approximatety 80' X 425' and çsnfaining 34000 square feet to Mark Rite Holding Co., LLÓ øi tn" appraised value of $3/square foot, - underthe requirements of Section 22-902 of the Billings, Montana City Code. 2) That the Billings City Council is initiating a zone chauge on the subjèct parcel from public to Highway Commercial.
