ORDINANCE NO. 02-5220 AN ORDINANCE OF THE CITY OF BILLINGS, PROVIDING THAT THE BILLINGS, MONTANA CITY CODE BE AMENDED BY REVISING SECTION 2-223; PROVIDING FOR ONE PUBLIC HEARING AT THE FIRST READING OF AN ORDINANCE OR ON ANY MATTER REQUIRING A HEARING UNLESS A CONTINUANCE OR POSTPONEMENT IS REQUESTED AND GRANTED BY THE MAYOR AND CITY COUNCIL. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BILLINGS, MONTANA: Section 1. That Section 2-223 of the Billings, Montana City Code, be amended so that such section shall read as follows: “Sec. 2-223. Public hearings on ordinances. At the time appointed for the first second reading and adoption of any new or amended an ordinance, the public shall have the right to appear and present individual or collective views on the proposed adoption. This hearing shall be afforded during the regular council meeting at the time that particular item is heard on the agenda. If a public hearing on any matter is required by any law or is optional at the request of the Mayor and City Council, only one public hearing shall be held before the Mayor and City Council on such issue. This hearing shall be afforded during the regular council meeting at the time that particular item is heard on the agenda and upon the first consideration of the action requiring the public hearing. Provided, however, that this limitation on required public hearings does not restrict the Mayor and City Council’s ability to invite public input on issues before them for consideration. Upon request of any interested persons, the advertised public hearing may be continued or postponed to a specific date and time in the sole discretion of the Mayor and City Council, provided such postponement does not violate any deadlines or time limits imposed by law.” Section 2. EFFECTIVE DATE. This ordinance shall be effective thirty (30) days after second reading and final adoption as provided by law. Section 3. REPEALER. All resolutions, ordinances, and sections of the City Code inconsistent herewith are hereby repealed. ---PAGE BREAK--- ORD NO 02-5220 2 Section 4. SEVERABILITY. If any provision of this ordinance or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect the other provisions of this ordinance which may be given effect without the invalid provisions or application, and, to this end, the provisions of this ordinance are declared to be severable.
