1 ORDINANCE NO. 04-5279 AN ORDINANCE TO EXPAND THE BILLINGS TOWNSITE HISTORIC DISTRICT ON PROPERTY GENERALLY LOCATED IN THE 2600 AND 2500 BLOCKS ON THE SOUTH SIDE OF MONTANA AVENUE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BILLINGS, MONTANA: 1. RECITALS. Title 76, Chapter 2, Part 3, MCA, and Sections 27-302 and 27-1502, BMCC, provide for amendment to the City Zoning Map from time to time. The City Zoning Commission and staff have reviewed the proposed zoning for the real property hereinafter described. The Zoning Commission and staff have considered the twelve (12) criteria required by Title 76, Chapter 2, Part 3, MCA. The recommendations of the Zoning Commission and staff have been submitted to the City Council, and the City Council, in due deliberation, has considered the twelve (12) criteria required by state law. 2. ZONE AMENDMENT. The boundaries of the Billings Townsite Historic District, as established in Ordinance No. 4112, are hereby expanded to include the area described as follows: BEGINNING AT THE NORTHWEST CORNER OF THE RIGHT-OF-WAY INTERSECTION OF NORTH 26TH STREET AND MONTANA AVENUE, LOCATED IN THE ORIGINAL TOWN OF BILLINGS, SAID POINT BEING THE POINT OF THE BEGINNING; THENCE, SOUTHWESTERLY TO THE EASTERLY RIGHT-OF-WAY OF NORTH 27TH STREET AND MONTANA AVENUE; THENCE SOUTHEASTERLY ALONG THE EASTERN RIGHT-OF-WAY OF NORTH 27TH STREET TO THE CENTER LINE OF THE BURLINGTON NORTHERN RIGHT-OF-WAY, THENCE NORTHEASTERLY TO THE WESTERN BOUNDARY OF THE EXISTING BILLINGS TOWNSITE HISTORIC DISTRICT, THEN FOLLOWING THE WESTERN BORDER OF THE EXISTING DISTRICT TO THE POINT OF THE BEGINNING. From the effective date of this ordinance, all properties included in this expansion shall be subject to all the rules and regulations pertaining to the Billings Townsite Historic District as delineated in Section 27-507, et seq in the Billings, Montana City Code. 3. REPEALER. All ordinances or parts of ordinances in conflict herewith are hereby repealed. 4. EFFECTIVE DATE. This ordinance shall be effective from and after final passage and as provided by law.
