1 ORDINANCE NO. 04-5286 AN ORDINANCE OF THE CITY BILLINGS PROVIDING THAT THE BILLINGS, MONTANA, CITY CODE BE AMENDED BY REVISING SUBSECTION 27-713 TO EXPAND THE MONTANA AVENUE SIGN DISTRICT AND REVISING SECTION 27-713(1). NOW, WHEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BILLINGS, MONTANA: WHEREAS, the City Zoning Commission recommended that the Montana Avenue Sign District be expanded to meet the goals of the Downtown Framework Plan as desired by property owners, and WHEREAS, the City Council of Billings believes that the expansion of the sign district will contribute to the historical preservation and promote continued economic development of Montana Avenue. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BILLINGS, MONTANA: Section 1. That Section 27-713 of the Billings, Montana City Code be revised and such section shall read as follows: Section 27-713(1). District Boundaries Sec. 27-731. District boundaries. The Montana Avenue sign district extends from the west sidecenterline of North 19th22nd Street to the east sidecenterline of North 30th Street along Montana Avenue. The district extends from Montana Avenue north to the alley along any side street. and from Montana Avenue south to the railroad tracks along any side street. (See attached map). Section 2. EFFECTIVE DATE. This ordinance shall be effective thirty (30) days after second reading and final adoption as provided by law. Section 3. REPEALER. All resolutions, ordinances, and sections of the City Code inconsistent herewith are hereby repealed. Section 4. SEVERABILITY. If any provision of this ordinance or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect the other provisions of this ordinance which may be given effect without the invalid provisions or application, and, to this end, the provisions of this ordinance are declared to be severable.
