RESOLUTTON NO. 08-18733 A RESOLUTION OF THE CITY OF BILLINGS, MONTANA, DISCONTINUING AND VACATING a portion of Ríqht of Wav within Lake Hills Subdivision 25th Filinq. WHEREAS, a proper petition was filed with the City Council of the City of Billings, Montana, as per Section 22-601 BMCC, requesting discontinuance and vacation of a poÉion of Riqht of Wav within Lake Hills Subdivision 25th Filiñq as described hereinafter; and WHEREAS, a public hearing was properly noticed and held as required by law. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BILLINGS, MONTANA, AS FOLLOWS: 1. DISCONTINUANCE AND VACATION. Pursuant to Sections 7-14-4114 and 7-14-4115, M.C,A,, a po¡tion of Riqht of Wav within Lake Hills Subdivision 25th Filinq more pafticularly described as follows: A tract of land being approximately 200 feet of the East end of Lake Heights Drive right-of-way (60' wide) located in Lake Hills Subdivision 25'n Filing in the southeastquarterof Section 9, T.1N., R.26E., P.M.M., Yellowstone County, Montana more particularly described as follows: Beginning at the southeast corner of Lot Block 65, Lake Hills Subdivision 25'n filing; Then S03o04'24"E, 60,09 feet along the'East line of Lake Hills 25'n to the northeast corner of Lot 1, Block 62 Lake Hills 25tn; then N89o5'1'27"W,200.98 feet along the north line of said Lot 1, Block 62; then along a 56.00 foot radius curve to the left with a delta of 64"53'56' and a chord bearing N03o20'58'E, 60.09 feet to a point on the south line of Lot 2, Block 65, Lake Hills 25'n; then S89o51'27"8,194.24 feet along the south lines of Lots 2 and Block 65 to the Point of Beginning. The herein described area to be vacated is '11500 square feet. ls hereby discontinued, abandoned and vacated. 2. Pt-,fBLlÇ INTEREST. The discontinuance, vacation and abandonment of the above described a port¡on ôf Riqha of Wav w¡th¡n Lake H¡lls Subd¡viqion ZSth F¡l¡nq is in the best interest of the public and can be done without any public detriment.
