Anyone starting or causing a fire is responsible for putting it out amd may be held lialbe for damages or suppression costs, If you lose control of a bum, phone 9-1-1 without delay and request assistance. BIG HORN COUNTY SHERIFFS OFFICE 665-9860 MONDAY THUR FRIDAY 8AM TO 4PM 665-9780 EVENINGS AND WEEKENDS ---PAGE BREAK--- LEGAL NOTICE REGARDING OPEN BURNING AND FIRES fN BIG HORN COUNTY On July 24, 2000, pursuant to MCA 7-33-2205, the Big Hom County Board of Commissioners passed Resolution 200-44, establishing fire control measures on all forest, range and croplands in any state and private properties within the county except lands located within incorporated areas, the forest service boundaries, those managed by the Bureau of Land Management, or the Bureau of Indian Affairs, (The fore named agencies have established similar fire control measures within their jurisdictions.) The Resolution prohibits the igniting or setting ofany forest fire, sl~ burning fire, land clearing fire, debris-burning fire, or open fire without first obtaining a written permit from the County Fire Marshall. Furthermore the discharge of all fireworks is strictly prohibited. Pursuant to MCA 7-33-2206 any person violating this Resolution shall be guilty of a misdemeanor, punishable by a fine of up to $550 and sic months in the county jail. Even when granted a permit, under the provision of MCA 50-63-103, any person igniting or setting a fire is liable for any and all fire suppression costs and damages resulting from an escaped and/or uncontrollable fire. Under the provisions of MCA 45-6-102, a person commits the offense of negligent arson if he purposely places the property of another in danger of damage or destruction and can be fined $500. When necessitated by poor quality, the State of Montana Department of Environmental Quality prohibits open burning declared periods. Penalties for violations of the State Open Burn Restrictions run high as $10,000 per violation per day. Administrative Rules of Montana 17.8.606. Permission to burn will not be granted during periods of extreme fire danger or frre activity or during a State declared Burning Prohibition.
