It was reviewed by the Belgrade City- County Planning Staff. The following are comments about the project: Reviewing Authority and Criteria: 1. The property is located within the jurisdiction of the Belgrade City/County Planning Board, which, according to the Gallatin County Subdivision Regulations (Section considers the following in reviewing proposals: a. Relevant evidence relating to the public health, safety and welfare. b. Environmental information. c. Other regulations in effect in the area of the proposed subdivision. d. Whether the preliminary plat conforms to the provisions of: 1. Any officially adopted growth policy for the area involved (Belgrade Growth Policy) 2. Applicable zoning regulations (Zoned MR - Mixed Residential) ---PAGE BREAK--- 3. The Montana Subdivision and Platting Act 4. The Gallatin County Subdivision Regulations. After the public hearing and Planning Board review, the Planning Board shall submit in writing to the Gallatin County Commission: a. Its advice regarding the items described above. b. A recommendation for approval, conditional approval, or disapproval of the plat, or no official recommendation. 2. According to Section 3.K. of the Subdivision Regulations, the County Commission may not approve or conditionally approve a subdivision application and preliminary plat unless the proposed subdivision: a. Complies with the survey requirements of 76-3-401 through 406 MCA; b. Provides easements for the location and installation of any planned utilities; c. Provides legal and physical access to each parcel within the subdivision and the notation of that access on the applicable plat and any instrument transferring the parcel; d. Assures that all required public or private improvements will be installed before final plat approval, or that their installation after final plat approval will be guaranteed as provided by Section 8 of these Regulations; and e. Assures that the requirements of 76-3-504(1)0), MCA, regarding the disclosure and disposition of water rights has been considered and will be accomplished before the final plat is submitted. f. Assures that the requirements of 76-3-504(1)(k), MCA regarding watercourse and irrigation easements has been considered and will be accomplished before the final plat is submitted. g. Provides for the appropriate park dedication or cash-in-lieu (76-3-621, MCA) 3. In approving, conditionally approving, or denying a subdivision preliminary plat, the County Commission shall consider whether the proposed subdivision complies with: ---PAGE BREAK--- a. The Subdivision Regulations, including, but not limited to, submittal requirements of Section 5 and the standards set forth in Sections 6 and 7 of the Subdivision Regulations. b. Applicable zoning regulation design standards. c. Other applicable regulations and standards; and d. consideration of any variance from the standards set forth in Section 6 or these Regulations 4. In making its decision to approve, conditionally approve, or deny a proposed subdivision, the County Commission may consider and weigh the following, as applicable: a. The subdivision application and preliminary plat; b. The environmental assessment; community impact: flood study and/or flood hazard evaluation; traffic impact study. c. The summary of probable impacts and mitigation; d. The Montana Subdivision and Platting Act (MSPA), specifically as to how the proposed subdivision addresses impacts on Agriculture, Agriculture Water User Facilities, Local Services, the Natural Environment, Wildlife, Wildlife Habitat, and Public health and safety. e. Any officially adopted Growth Policy, Neighborhood Plan or Development Pattern (76-2-104 MCA) for the area involved (Belgrade Growth Policy and the Triangle Community Plan are applicable) f. Comments, evidence and discussions at the public hearing(s). g. Subdivision Administrator's staff report, findings and conclusions. h. Planning board recommendation. i. Any additional information authorized by law. Subdivision Design Standards: 1. The proposed subdivision is located within the Central Valley Fire District. The Gallatin County Subdivision Regulations require that one of the fire protection packages provided for in Appendix I of the Regulations be met. Consult with the Central Valley Fire Marshall for the appropriate fire ---PAGE BREAK--- protection package for this project. Include the Fire Department's comments with the preliminary plat application. Please specify in the preliminary plat application which fire protection will be used. If the applicant is allowed to use a fire protection water supply from off- site, the applicant must obtain a use agreement with the entity responsible for maintaining the fire protection water supply. Address the method of domestic water supply and wastewater disposal for the subdivision. Verify with the DNRC that there is adequate water for the subdivision with the preliminary plat submittal. 2. Provide an approved Noxious Weed Control and Re-vegetation Plan with the preliminary plat application as required under section 6.P. of the Gallatin County Subdivision Regulations. 3. See the Gallatin County Transportation Design and Construction Standards for road and pedestrian facility requirements. Consult with the Gallatin County Road and Bridge Department Engineer regardingon and off-site road requirements for the project. Off-site improvements may be required. 4. Variance requests must be made with the preliminary plat and meet the review criteria of Section 12 of the Gallatin County Subdivision Regulations and explained in detail to eliminate confusion. General Comments. 1. Fire protection requirements are listed in the Gallatin County Subdivision Regulations Section 6.G and shall be required to be met. 2. The project is zoned MR - Mixed Residential. The intent of this district is to “Permit multi-unit residential uses in a diversity of housing types with a mix of neighborhood amenities.” 3. This is a first minor subdivision from a tract of record. The project will be reviewed following the procedures outlined in Section 4 and other applicable provisions of the Gallatin County Subdivision Regulations. 4. An avigation easement is always required in the Belgrade area to protect the Bozeman- Yellowstone International Airport's right to operate. Details on the avigation easement can be obtained from the Gallatin Airport Authority. 5. See section and 6.A.6 and 6.F.3 for requirements for water conveyance facilities regarding the irrigation ditches on or near the property. Irrigation ditch owners should be contacted prior to the preliminary plat submittal. Appendix K of the subdivision regulations lists the standard irrigation ditch requirements. ---PAGE BREAK--- 6. Parkland dedication is not required for minor subdivisions. The following information and/or documentation must be provided with the preliminary plat application: 1. Provide all preliminary plat information and materials as required in the Gallatin County Subdivision Regulations. 2. If mail delivery will not extend to individual lots, please delineate an off- road area for mail delivery in cooperation with the United States Postal Service. 3. If any improvements are planned to be completed under an improvements’ agreement with the County, you must make this request with the preliminary plat application and submit drafts of the agreements for the County to review. 4. Please address any variance requests from roads, access or other design standards as outlined in the Gallatin County Subdivision Regulations.
