ORDINANCE NO 2009 1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BELGRADE MONTANA PROHIBITING THE DISCHARGE OF FIREARMS BB GUNS AIR GUNS PELLET GUNS OR BOWS AND ARROWS WITHIN THE CITY LIMITS WITH CERTAIN EXCEPTIONS PROHIBITING FIREARMS BB GUNS AIR GUNS PELLET GUNS EXLPOS VE DEVICES AND BOWS AND ARROWS IN PUBLIC MEETINGS WITH CERTAIN EXCEPTIONS AND PROHIBITING FIREARMS BB GUNS AIR GUNS PELLET GUNS AND BOWS AND ARROWS IN PUBLIC BUILDINGS PARKS AND SCHOOLS WITH CERTAIN EXCEPTIONS BE IT ORDAINED by the City Council of the City of Belgrade Montana The following provisions are hereby adopted as Chapter 9 10 of the Official Code of the City of Belgrade and shall be entitled WEAPONS 9 10 010 Definitions 1 Arrow shall mean a shaft usually pointed at one end and feathered or vaned at the other and designed for shooting from a bow 2 Bow shall mean a flexible curved device with the ends connected by cord or wire and designed for shooting arrows The term bow includes cross bow compound bow recurve bow traditional bow or any other type of bow 3 Firearm shall mean a pistol rifle shotgun or any other type of instrument or device commonly known as a firearm but shall not include an air gun BB gun or pellet gun 9 10 20 Discharge of Firearms or Bows and Arrows Prohibited Exceptions 1 It is unlawful for any person to shoot fire or discharge any firearm within the city limits of the City of Belgrade or on any premises owned or controlled by the city 2 It is unlawful for any person to shoot fire or discharge a BB gun air gun pellet gun or bow and arrow within the city limits of the City of Belgrade or on any premises owned or controlled by the city except on private property with the permission of the owner or occupant of such property and under circumstances when such 6B gun air gun pellet gun or bow and arrow can be fired discharged or operated in such manner as not to endanger any person or property and also in such manner as to Ordinance No 2009 1 Page 1 ---PAGE BREAK--- prevent any BB pellet projectile or arrow from traversing any grounds or space outside the limits of such private property 3 This section shall not apply to the city police or other peace officers of the United States or the State of Montana in the discharge of their duty or when done in the lawful use of force in the defense of the person property or family 4 The city manager or his or her designee may upon application issue permits to gun clubs gun ranges exhibitions or other shooting events and such permits shall specify the place time date or dates and any other requirements which may be deemed reasonable or necessary The city council may establish from time to time by resolution a fee for any such permit 9 10 030 Firearms Bows and Arrows Explosive Devices BB Guns Air Guns and Pellet Guns Prohibited in Public Buildings Parks and Schools Exceptions 1 No person shall wear bear or otherwise carry into any publicly owned or leased building park or school located in the city limits of the City of Belgrade any firearm whether concealed or unconcealed any explosive device any BB gun air gun or pellet gun or any bow and arrow 2 This section shall not apply to i City police or other peace officers of the United States or the State of Montana in the discharge of their duty ii Persons participating or displaying firearms BB guns air guns pellet guns or bows and arrows at shows authorized by the city or school iii Persons participating in hunter or firearm safety courses sanctioned by the Montana Department of Fish Wildlife and Parks and or authorized by the city or school or iv Persons specifically authorized by the city or school to carry firearms BB guns air guns pellet guns bows and arrows or demonstrate or use explosive devices on its premises 9 10 040 Firearms Prohibited in Public Meetings 1 It is unlawful for any person other than city police or other peace officers of the United States or the State of Montana in the discharge of their duty to attend a public meeting anywhere within the City of Belgrade wearing bearing or carrying a firearm BB gun air gun pellet gun bow and arrow or explosive device unless specifically authorized by the agency conducting the public meeting Ordinance No 2009 1 Page 2 ---PAGE BREAK--- 2 For the purposes of this section a Public Meeting means the convening of the public or governmental bodies boards bureaus commissions agencies of the state or any political subdivision of the state for the purpose of hearing discussing or acting upon a matter over which the agency has supervision control jurisdiction or advisory power 9 10 050 Violations Penalty Any person who violates any of the provisions of Chapter 9 10 shall upon conviction thereof be punished by a fine not exceeding 500 or by imprisonment not to exceed 6 months or both such fine and imprisonment for each such offense Passed adopted and approved by the City Council of the City of Belgrade Montana at regular session held on
