It was reviewed by the Belgrade City- County Planning staff. The proposals were forwarded to the Central Valley Fire Marshall and the Belgrade Public Works Department. The following are comments about the project. Reviewing Authority and Criteria. 1. The property is located within the jurisdiction of the Belgrade City/County Planning Board, which, according to the Belgrade City Subdivision Regulations (Section considers the following in reviewing proposals: a. Relevant evidence relating to the public health, safety and welfare. b. Environmental information. c. Other regulations in effect in the area of the proposed subdivision. d. Whether the preliminary plat conforms to the provisions of: 1. Any officially adopted growth policy for the area involved (Belgrade Growth Policy) 2. The Montana Subdivision and Platting Act 4. The Belgrade City Subdivision Regulations. After the public hearing and Planning Board review, the Planning Board shall submit in writing to the City Council: a. Its advice regarding the items described above. b. A recommendation for approval, conditional approval, or disapproval of the plat, or no official recommendation. 2. According to Section 4.J of the Subdivision Regulations, the City Council may not approve or conditionally approve a subdivision application and preliminary plat unless the proposed subdivision: a. Provides easements for the location and installation of any planned utilities; b. Provides legal and physical access to each parcel within the subdivision and the notation of that access on the applicable plat and any instrument transferring the parcel; c. Assures that all required public or private improvements will be installed before final plat approval, or that their installation after final plat approval will be guaranteed as provided by Section 8 of these Regulations; and d. Assures that the requirements of 76-3-504(1)(j), MCA, regarding the disclosure and disposition of water rights has been considered and will be accomplished before the final plat is submitted. e. Assures that the requirements of 76-3-504(1)(k), MCA regarding watercourse and irrigation easements has been considered and will be accomplished before the final plat is submitted. In approving, conditionally approving, or denying a subdivision preliminary plat, the City Council shall consider whether the proposed subdivision complies with: a. The Subdivision Regulations, including, but not limited to, submittal requirements of Section 5 and the standards set forth in Sections 6 and 7 of the Subdivision Regulations; b. Applicable zoning regulations; c. Other applicable regulations; d. The MSPA, including but not limited to the Summary of the Probable Impacts Criteria, Section 9 of the Subdivision Regulations. ---PAGE BREAK--- Thomas B. Quaw Square ▪ 91 E. Central ▪ Belgrade, MT 59714 Phone: (406) 388-3760 ▪ Fax: (406) 388-4996 3 In making its decision to approve, conditionally approve, or deny a proposed subdivision, the City Council may consider and weigh the following, as applicable: a. The subdivision application and preliminary plat; b. The environmental assessment; community impact report; flood study and/or flood hazard evaluation. c. The summary of probable impacts and mitigation; Subdivision Design Standards: 1. The project must comply with the current version of the International Fire Code. Fire hydrants are required to be installed to City standards and be reviewed and approved by the Central Valley Fire Department. 2. City water and sewer utilities are required to be installed to City and State DEQ standards. 3. Provide an approved Noxious Weed Control and Re-vegetation Plan with the preliminary plat application as required under section 6.L. of the Belgrade City Subdivision Regulations. 4. See Section 7 of the Belgrade City Subdivision Regulations for transportation design and improvement standards. Consult with the Belgrade City Engineer about on and off-site road requirements for the project. Interior roads will be required to be constructed to City standards. At a minimum, a waiver of right-to-protest future SID’s for improvements to all roads and infrastructure in the subdivision will be required unless a variation from Belgrade City Public Works specification is granted. The project will have to comply with the Belgrade Area Long Range Transportation Plan and a traffic impact study will be required. 5. Variance requests must be made with the preliminary plat and meet the review criteria of Section 13.A. of the Belgrade City Subdivision Regulations and explained in detail to eliminate confusion. 6. This project will have to comply with the Belgrade Area Long Range Transportation Plan and the Airport Master Plan. ---PAGE BREAK--- Thomas B. Quaw Square ▪ 91 E. Central ▪ Belgrade, MT 59714 Phone: (406) 388-3760 ▪ Fax: (406) 388-4996 4 General Comments: 1. Interior roads must be built to City Standards and within public dedicated right-of- ways. 2. Driveway Access encroachments onto City Streets must be approved by the Belgrade City of Public Works Department. 3. Fire protection is required as per the current adopted addition of the International Fire Code and City specifications. 4. A Flood Hazard Evaluation (FHE) reviewed by the Belgrade City Floodplain Administrator is required for the property as per Section 10 of the Belgrade City Subdivision Regulations for Hyalite Creek. 5. This appears to be a major subdivision. The project will be reviewed following the procedures outlined in Section 3 and other applicable provisions of the Belgrade City Subdivision Regulations. 6. An avigation easement is always required in the Belgrade area to protect the nearby Airport’s right to operate. 7. See section 6.A.5 and 6.D.3 for requirements for water conveyance facilities regarding the irrigation ditches on or near the property. Irrigation ditch owners must be contacted prior to the preliminary plat submittal. 8. The subdivision will have to meet the requirements of Section 6.G of the subdivision regulations for parkland (No parkland is required if this is a commercial subdivision). 9. Any new road names will have to be approved by the County GIS Department to ensure it is not a duplication within the City or County. 10. The site is located within the Belgrade City Limits and is Zoned M-1 (Commercial, Light Manufacturing). The intent of this district is to provide for community needs of wholesale trade, storage and warehousing, trucking and transportation terminals, light manufacturing, and similar activities. This district should be oriented to major transportation facilities, yet arranged to minimize adverse effects on residential developments. therefore, some type of screening may be necessary. Residences shall not be permitted in this district. 11. No new buildings shall be located within the Hyalite Creek Floodplain. 12. A common boundary realignment must be completed for Lot 19 and COS 45G before the final plat approval. ---PAGE BREAK--- Thomas B. Quaw Square ▪ 91 E. Provide all preliminary plat information and materials as required under Sections 5.C., items 1 through 8, and 5.D., items 1-10 of the Belgrade City Subdivision Regulations. 2. If mail delivery will not extend to individual lots, please delineate an off-road area for mail delivery in cooperation with the United States Postal Service. 3. If any improvements are planned to be completed under an improvements agreement with the City, you must make this request with the preliminary plat application, and submit drafts of the agreements for the City to review. 4. Please address any variance requests from roads, access or other design standards as outlined in the Belgrade City Subdivision Regulations.
