The following narrative is provided in response to Pre-Application review comments received from the department on September 15, 2023. Requested information and clarifications are made in the responses below and included documentation. • GCSR §5-B-3(c): Provide Abstract of Water Rights Response: Water rights for conveyance facilities have been provided by the local DNRC office. Abstracts are attached. • GCSR §5-B-6: There appears to be several water conveyance facilities located on this property. Provide evidence that proper notice has been provided to any applicable water right holders or incorporated ditch companies. If notice has not been provided, provide proper notice, and resubmit after notice has been provided and comment period has been given. Response: In cooperation with DNRC and current landowners all applicable water right holders have been identified for the property. Excluding the current landowners who are also the applicants, there is one person who has authorized use of the Weaver Ditch. Notice has been sent to the user with request for comment within 45- days in accordance with the Gallatin County Subdivision Regulations. Noticing letters are attached along with a sworn statement from the subdivider’s agent. In compliance with the regulations, any comments received will be included with the Preliminary Plat application. A second ditch currently exists on Tract 2. The ditch is not recognized as a conveyance facility and no water rights were identified for this ditch. Since the ditch is not utilized as a conveyance facility the 40’ easement in Tract 2 has been removed and will be omitted from the Preliminary Plat. The updated site layout is attached. B22-071 Dear Mr. Simonson, Weaver ditch has been identified as a water conveyance facility that is on or within 500’ of the subject property boundaries: Tract 2 of C.O.S. 3111 and Tract A-3 of C.O.S. 2383 located in the north half of section 26, Township 1 North, Range 4 East, PMM Gallatin County, Montana DNRC and property owners were contacted to identify all applicable water conveyance facility representatives with authorized use of the ditch. Applicable representatives were provided with written notice by TDH Engineering regarding proposed development for Leep Minor Subdivisions 1 & 2. In accordance with Gallatin County Subdivision Regulations, written notices included a copy of the proposed subdivision layout, a description of any adverse effects, and proposed mitigation for adverse effects as applicable. The subject property has the following legal description: Tract 2 of C.O.S. 3111 and Tract A-3 of C.O.S. 2383 located in the north half of section 26, Township 1 North, Range 4 East, PMM Gallatin County, Montana Tract 2 and Tract A-3 are each being developed for Minor Subdivision with the intent to annex into the City of Belgrade at a future date. Under annexation the tracts will likely be further subdivided into major subdivision developments. In cooperation with DNRC and current property owners we have identified all applicable water conveyance facility representatives with authorized use of the Weaver Ditch. This letter serves as a notice for the water conveyance facility’s authorized representatives. One new county road is proposed for construction under the Minor Subdivision phase. The road will connect to Bolinger Road approximately 1/4 mile south of the Weaver Road intersection. From its connection point it will run southeast and connect to Spooner Road 1/2 mile south of the Spooner/Weaver Road intersection. A new culvert is proposed for the Weaver Ditch crossing to maintain access to users. The culvert will be appropriately sized to maintain its current flow volume and alignment without imposing impact to upstream or users. Please reference the attached site plan for the location of the road and proposed crossing. Under future development the ditch may undergo further improvements to realign with a proposed north-south road that will provide public access through the development. Upon commencement of future design phases, you will receive additional notice of verified ditch line improvements. All current and future subdivision design will be completed in accordance with City of Belgrade design standards and Gallatin County Subdivision Regulations, and the Weaver ditch will be designed to maintain flow to users. The site layout provided has been submitted to the City of Belgrade Planning department for review.
