ORDINANCE NO. 12-12 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BAY COUNTY, FLORIDA, PROVIDING FOR AMENDMENTS TO TH~ BAY COUNTY STORMWATER MANAGEMENT CODE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; PROVIDING FOR INCLUSION IN CODE; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED by the Board of County Commissioners of Bay County, Florida: SECTION 1. PURPOSE. The purpose of this ordinance is to amend Article III, Chapter 25, Stormwater Management of the Bay County Code. SECTION 2. AMENDMENT. ARTICLE III, CHAPTER 25, Stormwater Managenlent, Section 25-101, Definitions, of the Bay County Code, is amended as set forth below with underlined text as additions and strikethrough text as deletions. Non-Residential Developed Property" means each developed parcel the Property Appraiser has classified as land use types Q3QQ, Q6QQ, Q8QQ, 1100 through 39QQ, 4100 through 49QQ, and 7100 through 7900 under the land use classifications of the Florida Department of Revenue, as set forth in § 12D - 8.008, Florida Administrative Code. Concerning land use types 0800 (Multi-family-less than 10 units), which have more than 4 units developed on a parcel owned by the same person or entity, the parcel shall be classified as non-residential developed property. "Residential Developed Property" means each developed parcel the Property Appraiser has classified as land use types~lQQ, Q2QQ, Q4QQ, Q500 and 5000, under the land use classifications of the Florida Department of Revenue, as set forth in § 12D - 8.008, Florida Administrative Code. Each unit in a condominium shall be a separate "residential developed property. II Concerning land use types 0800 (Multi-family-Iess than 10 units), which have 4 or less units developed on a parcel owned by the same person or entity, each unit shall be classified as residential developed property. SECTION 3. SEVERABILITY. If any section, subsection, clause, phrase, or provision of this Ordinance is held invalid or unconstitutional, such invalidity or unconstitutionality shall not be construed as to render invalid or unconstitutional the remaining provisions of this Ordinance. 1 ---PAGE BREAK--- Approved as to form: SECTION 4. REPEAL. All ordinances or parts of ordinances in conflict with this Ordinance are to the extent of such conflict hereby repealed. SECTION 5. INCLUSION IN CODE. This Ordinance shall become and be made a part of the Code of Bay County, Florida. Sections of this Ordinance may be renumbered or re-lettered and the word "ordinance" may be changed to /Isection", /Iarticle" or other appropriate designation. SECTION 6. EFFECTIVE DATE. A certified copy of this Ordinance as enacted shall be filed by the Clerk of the Board with the office of the Secretary of State of the State of Florida within ten (10) days after enactment and this Ordinance shall take effect immediately in accordance with Section 125.66 Florida Statutes.
