These conditions must be followed throughout the period in which the permit is active until final stabilization is achieved and the SDP is terminated. 1. The permittee must implement control measures to minimize the discharge of pollutants from all potential pollution sources at the site, which, if applicable, includes run-on. 2. The permittee must implement structural and/or non-structural control measures to effectively minimize erosion, sediment transport, and the release of other pollutants related to construction activity, prioritizing erosion control measures where feasible. Discharges authorized by this permit must not cause, have the reasonable potential to cause, or measurably contribute to an exceedance of any applicable water quality standard, including narrative standards for water quality. 3. Control measures used to meet effluent limitations must be installed prior to commencement of construction activities and prior to each phase of construction that introduces new potential pollutant sources. 4. All control measures must be selected, designed, installed, and maintained in accordance with good engineering, hydrologic, and pollution control practices. The permittee must keep all control measures in effective operating condition and protected from activities that would reduce their efficacy. 5. Control measures implemented at the site must be designed to prevent pollution or degradation of watercourses including state waters. 6. The permittee must implement a structural vehicle tracking control at each access location between disturbed and paved surfaces which convey stormwater into the MS4 or offsite to minimize vehicle tracking of sediment from disturbed areas. Vehicle tracking controls may also include a non-structural control measure. 7. Stormwater runoff from all disturbed areas and soil storage areas must flow to one or more control measures to minimize erosion or sediment in the discharge. The control measure(s) must contain or filter flows to prevent the bypass of flows without treatment and must be appropriate for the flow rate, duration, and flow conditions expected to occur in the given area. 8. Prioritize the use of construction phasing wherever feasible to minimize the amount of exposed soil at any point in time throughout the duration of construction. 9. The permittee must protect a 50-foot-wide buffer or “setback” of pre-existing vegetation between construction activities and receiving waters, unless infeasible. In addition to maintaining this buffer, the permittee must install control measures upgradient of the buffer to provide treatment for runoff prior to reaching the buffer. 11. The permittee must minimize soil compaction in all areas where infiltration control measures will be implemented or where vegetation will be used to achieve final stabilization. If compaction does occur, decompaction must be completed prior to planting. 12. The permittee must preserve topsoil for those areas of the site that will utilize vegetative final stabilization, unless infeasible. Preservation of topsoil can utilize stockpiling or can include leaving topsoil in place where disturbances will be minimal and will not result in mixing of topsoil with the subsoil. 13. The permittee must minimize the amount of soil exposed during construction, particularly on steep slopes. 14. Clean water diversions diversions of state waters around project areas) must be designed to minimize soil transport and erosion within the entire length of the diversion, minimize run-on into the diversion, and must meet one of the design requirements outlined by the Colorado Department of Public Health and Environment Water Quality Control Division (WQCD) in Part I.B.1.a.i(i) of general permit number COR400000. 15. Minimize dust through the appropriate application of water or other dust suppression techniques on areas of exposed soil. Dust suppression water must not be discharged offsite unless authorized by a separate permit. 16. Where sites will discharge directly to waters of the state, peak flowrates and total stormwater volume must be controlled to minimize channel and streambank erosion and scour in the immediate vicinity of the discharge. 17. Individual containers of liquid chemicals holding 55 gallons or more must be placed within secondary containment or equivalent protection. 18. The permittee must minimize spills and leaks. Upon identification, spills and leaks must immediately be contained and mitigated in accordance with the spill prevention and response plan. 19. The permittee must implement control measures designed for concrete washout waste, masonry operations, stucco waste, vehicle and equipment washing, and external building washing. Washing activities cannot contribute pollutants to stormwater runoff, receiving surface waters including the City of Arvada’s (Arvada’s) Municipal Separate Storm Sewer System (MS4), or groundwater. Concrete washout areas must be located away from areas of shallow groundwater to provide adequate buffering capacity. Firefighting water that contains pollutants and remains onsite after the active emergency response must be removed and disposed of, in order to minimize pollutant discharge from the site, unless infeasible. 21. The permittee must minimize the exposure of fertilizers, pesticides, and herbicides to stormwater during storage. Store and apply these materials per the manufacturer’s directions. 22. The permittee must ensure that wash water used for paint, form release oils, curing compounds, and similar is directed into an adequately sized leak-proof container or lined pit to prevent discharges to groundwater or overflows. All waste must ultimately be removed from the site and appropriately disposed of. 23. The permittee must implement temporary stabilization on any disturbed portion of the site where earth-disturbing construction activity has permanently ceased or has temporarily ceased for more than 14 calendar days. Acceptable methods include, but are not limited to surface roughening, soil tackifiers, hydromulch, crimp mulch, and tarps. The 14-day schedule may be exceeded if the function of the specific area requires it to remain disturbed, or if physical characteristics of the terrain/climate prevent stabilization. 24. This permit cannot be terminated until final stabilization has been achieved. This includes the following: 1. All construction activities are complete. 2. Permanent stabilization methods are complete. Permanent stabilization must be designed and installed as a permanent feature. 3. Vegetative cover must consist of evenly-distributed, perennial vegetation which may include trees and shrubs. Vegetation coverage must equal at least 70 percent of what would have been provided by native vegetation in a local, undisturbed area or adequate reference site. The WQCD may approve alternative final stabilization criteria for specific operations. Vegetation establishment and management shall be in conformance with Section 1020.00 - Soil Preparation, and 1030.00 - Grass Specifications, of Arvada’s Engineering Code of Standards and Specifications. Arvada will perform a final inspection at the site prior to authorizing permit termination to verify that final stabilization has been achieved and that all temporary, non-biodegradable control measures have been removed. 25. The permittee must start site inspections in accordance with this SDP within 7 calendar days of the commencement of construction activities on site. Note that these inspections are separate from Arvada’s routine inspections that are conducted in accordance with Arvada’s MS4 permit. 26. A Qualified Stormwater Manager, as defined by the division in General Permit COR400000 must conduct all inspections completed to comply with the minimum inspection frequency. The QSM performing inspections may be on the construction site staff or a third party under the ---PAGE BREAK--- 8101 Ralston Road, Arvada, CO 80002 Phone: [PHONE REDACTED] ArvadaCO.gov 711 Relay Colorado for Deaf, Hard of Hearing and Speech Disabilities direction of the construction site staff. 27. The QSM must complete an inspection at least once every 7 calendar days, or at least once every 14 calendar days plus within 24 hours after the end of any precipitation or snowmelt event that cause surface erosion, unless the site qualifies for one of the alternative schedules below: 1. If the site is on a 14-day plus post-storm schedule and no construction activities will occur following a storm event, a post-storm inspection must be conducted prior to recommencing construction, but no later than 72 hours after the end of the runoff event that causes surface erosion. Such delayed inspections must be documented in the inspection record. Routine inspections must still occur at least every 14 days. 2. If all or some of the site is awaiting establishment of vegetative ground cover and final stabilization, an inspection must be conducted at least once every 30 days, with no post- storm inspection requirement. To qualify for this reduced frequency, all construction activities resulting in ground disturbance must be complete, all activities required for final stabilization must have been completed, with the exception of the application of sod or seed that has not occurred due to seasonal conditions or the necessity for additional seed application to augment previous efforts, and the stormwater management plan must be updated to identify the areas being inspected on this reduced schedule. 3. If the conditions for Winter Exclusion, as defined in Part I.D.4.c. of General Permit COR400000, are met, the site may cease inspections temporarily while the conditions continue to be met. It is not anticipated that this exclusion will apply within Arvada, due to the local climate. 4. If site conditions make 7-day or 14-day plus post-storm inspections impractical, the permittee may petition the division to grant an alternate inspection schedule. The alternate inspection schedule must be granted in writing by the division and incorporated into the Stormwater Management Plan (SWMP) prior to implementation. 28. Inspections must evaluate the following areas, if applicable, for evidence of or the potential for pollutants leaving the construction site boundaries, entering the storm sewer system, or discharging to state waters: 1. Construction site perimeter. 2. All disturbed areas, including areas that are temporarily stabilized. 3. Locations of installed control measures. 4. Designated haul routes. 5. Material and waste storage areas exposed to precipitation. 6. Locations where stormwater has the potential to discharge offsite, including visible erosion and sedimentation. 8. Locations where vehicles exit the site. 29. Inspections must: 1. Visually verify whether all implemented control measures are in effective operational condition and are working as designed in their specifications to minimize pollutant discharges. 2. Assess pumped stormwater discharges for a sediment plume, suspended solids, unusual color, decreased clarity, or presence of an odor or foam to help evaluate whether pumped stormwater is effectively managed. 3. Determine if there are new potential sources of pollutants. 4. Assess the adequacy of control measures at the site to identify areas requiring new or modified control measures to minimize pollutant discharges. 5. Identify all areas of non-compliance with the permit requirements and if necessary, implement corrective actions. 30. When an inadequate control measure is identified, the following corrective action requirements apply: 1. Take all necessary steps to minimize or prevent the discharge of pollutants from the permitted area and manage any stormwater run-on onto the site until a control measure is implemented and made operational and/or an inadequate control measure is replaced or corrected and returned to effective operating condition. 2. If it is infeasible to install or repair the control measure immediately after discovering the deficiency, add a description of why it is infeasible to initiate the installation or repair immediately and a schedule for installing or repairing the control measure and returning it to an effective operating condition as soon as possible to the SWMP. 31. If applicable, the permittee must remove and properly dispose of any unauthorized release or discharge within and from the permitted area. The permittee must clean up any contaminated surfaces, if feasible, to minimize discharges of the material in subsequent storm events. This includes water that contains pollutants associated with an emergency firefighting response that remains at the site after the response is complete. The permittee shall not hose down an area to clean spills or leaks, unless the wash water is captured and properly disposed of. Any sediment that accumulates outside of the site boundaries must be mitigated to the extent feasible. 32. The WQCD reserves the right to require sampling and testing on a case-by-case basis as outlined in General Permit COR400000. The permittee must comply with the lawful requirements of federal agencies, municipalities, counties, drainage districts, and other local agencies including applicable requirements in the Arvada MS4 Management Program developed to comply with its own CDPS MS4 Permit. 34. All construction site waste must be properly managed to prevent potential pollution of state waters. This permit does not authorize on-site waste disposal. 35. This permit does not relieve the permittee of the reporting requirements in 40 CFR 110, 40 CFR 117, or 40 CFR 302. Any discharge of hazardous material must be handled in accordance with the WQCD’s Noncompliance Notification Requirements. 36. The permittee must develop a SWMP and implement the SWMP as written and updated from commencement of construction activity until final stabilization is complete. Public emergency- related sites must create and implement the SWMP no later than 14 days after the commencement of construction. The WQCD and Arvada may review the plan. The SWMP must be prepared in accordance with good engineering, hydrologic, and pollution control practices. The permittee must update the SWMP as appropriate and keep a record of any changes. The record must include the date and identify what change(s) were made. The permittee must amend the SWMP under the following circumstances: 1. A change in design, construction, operation, or maintenance of the site requires the implementation of new or revised control measures. 2. The plan proves ineffective in controlling pollutants in stormwater runoff in compliance with the permit. 3. Control measures identified in the plan are no longer needed and are removed. 4. Corrective actions are taken onsite that result in a change to the plan. 5. Some or all of the site qualifies for reduced frequency inspections. For SWMP revisions made prior to or following a change onsite, including revisions to sections addressing site conditions and control measures, a notation must be included in the SWMP that identifies the date of the site change, the control measure removed or modified, the location(s) of the control measure, and any changes to the control measure(s). 37. The permittee must keep a copy of the SWMP onsite when construction activities are occurring unless the permittee specifies another location for storage and receives written approval to do so from the WQCD. 38. The SWMP may be prepared, signed, and maintained electronically if the records can be read in a similar manner to a paper record and the records are immediately accessible to a WQCD or Arvada inspector during an inspection to the same extent that a paper copy would be. In all cases, a copy of the SWMP must be retained onsite when construction activities are occurring unless the permittee has received written approval from the WQCD to store the SWMP ---PAGE BREAK--- 8101 Ralston Road, Arvada, CO 80002 Phone: [PHONE REDACTED] ArvadaCO.gov 711 Relay Colorado for Deaf, Hard of Hearing and Speech Disabilities elsewhere. 39. The permittee must maintain records of all inspections conducted for the site in the SWMP. Inspection records must identify any instances of noncompliance with the terms and conditions of this permit. Reports must include, at a minimum: 1. Inspection date. 2. Name(s) and title(s) of the person(s) conducting the inspection. 3. Weather conditions at the time of inspection. 4. Phase of construction at the time of inspection. 5. Estimated acreage of disturbance at the time of inspection. 6. Location(s) and identification of control measures requiring routine maintenance. 7. Location(s) and identification of sediment or other pollutants from the site. 8. Location(s) and identification of inadequate control measures. 9. Location(s) and identification of additional control measures needed that were not in place at the time of inspection. 10. Descriptions of corrective actions taken for items VII, VIII, and IX, dates on which the corrections were completed, including requisite changes to the SWMP as necessary. 11. Description of the minimum inspection frequency utilized when conducting the inspection. 12. Deviations from the minimum inspection schedule. This would include documentation of WQCD approval for an alternate inspection schedule, if applicable. 13. After adequate corrective action(s) have been taken, or where a report does not identify any incidents requiring corrective actions, the report must contain the following statement provide the date of the statement: “I verify that, to the best of my knowledge and belief, that if any corrective act ion items were identified during the inspection, those corrective actions are complete, and the site is currently in compliance with the permit.” 14. A signature by a Qualified Stormwater Manager. 40. The permittee must retain the complete SWMP, including inspection records for a period of at least 3 years following the closure of this permit. 41. The permittee must provide a copy of the SWMP to the WQCD, EPA, and Arvada upon request and within the timeframe specified in the request. The submission must include a signed ---PAGE BREAK--- 8101 Ralston Road, Arvada, CO 80002 Phone: [PHONE REDACTED] ArvadaCO.gov 711 Relay Colorado for Deaf, Hard of Hearing and Speech Disabilities certification stating that the plan is complete and compliant with all terms and conditions of General Permit COR400000. All required under this permit are considered reports that must be available to the public under Section 308(b) of the CDPS regulations. The permittee must make plans available to members of the public upon request, though the permittee may claim any portion of a stormwater management plan as confidential in accordance with 40 CFR Part 2. 42. If Arvada observes a pattern of chronic or recalcitrant violations, Arvada may implement control measures and draw on the project’s collateral to reimburse costs incurred, including a 50% administrative/inspection fee. Any security or portion thereof withdrawn by Arvada must be replaced in full by the developer prior to work commencing again on the site. If payment is not made, a Stop Work Order will be issued until the funds are replaced. 43. In the event a permittee sells, conveys, assigns, dedicates, or otherwise effectuates a change in ownership of all or part of a site, subdivision filing, or lot that is subject to a valid Site Development Permit, the old owner and new owner of the site, subdivision filing, or lot shall submit a Permit Transfer Form to transfer responsibility for the Site Development Permit.
