Athletic Field Rental Rules and Agreement Please read each of the following terms and conditions of this Agreement. 1. Permittee agrees to comply with all applicable rules, regulations, and policies of the City of Arvada. Any misuse may result in the cancellation of this Agreement and future permits. Permittee will be responsible for his/her/their own actions and the actions of the parties represented as a result of this permit. 2. The City of Arvada does not permit any sub-permitting of fields. 3. Motorized vehicles, other than electric powered wheelchairs, are prohibited. 4. No commercial concessions shall be operated or charged. No donation requests of any kind may be made of the public on the premises. Programs, circulars, pamphlets, handbills, etc. shall not be sold or given away. No advertising is permitted without prior City of Arvada approval. 5. All merchandise and non-food items may only be sold by vendors who hold the proper permit from the City of Arvada. 6. At termination of the permitted use, the area shall be restored to a litter- and damage-free condition. Repair or cleanup beyond normal use will be billed to the Permittee based on cost of service. 7. If additional security or traffic control measures are required, the City of Arvada will not assume any financial responsibility or liability, but will assist with coordination functions and arrangements. 8. Tents, booths, stands, awnings, canopies, sunshades, etc. are prohibited without the express written consent of the City of Arvada. 9. Permittee will be held accountable for all destruction, damage, or removal of any vegetation. Damage, destruction, or defacement of City of Arvada property is prohibited. 10. Disorderly conduct and/or abusive language are prohibited. 11. Swimming, wading, boating, rafting, or tubing are prohibited in all waterways. 12. Any machine or device for the purpose of amplification of human voice, music, or any other sound is prohibited without the express written consent of the City of Arvada. Parks within the City of Arvada require a permit from the City of Arvada to ensure compliance with the noise ordinance. 13. Parks are open from 6:00 a.m. to 11:00 p.m. daily. Overnight parking is not allowed. The curfew for athletic field lights is 11:00 p.m. 14. Pets must be on a leash not to exceed 6 feet in length. Owners must immediately pick up ---PAGE BREAK--- after their pets. 15. Consumption of alcoholic beverages requires prior approval and the issuance of a permit pursuant to Arvada’s Code Ordinances, Chapter 6, and Article III. Only reservations with a Special Events Permit are allowed to serve alcohol on parks property providing they demonstrate in writing how they will control the premises. Pavilion rentals and alcohol City’s permits can be obtained through the City. More information can be found on the Park Pavilion Rental page. 16. No participant or spectator involved in any organized games or contests may consume alcoholic beverages. 17. A copy of the use permit must be in the possession of the Permittee or designated representative at all times during use. The permit must be shown to City personnel upon request. 18. Under no circumstances are field users permitted to drive vehicles onto fields for any purpose. This includes snow removal, equipment drop-off, or set up. Should this take place, said Permittee will be responsible for all damages to turf and irrigation equipment. The Permittee will be charged for the damages, and may lose all rights to future field use. 19. No materials are to be added to the field surface. Field prep and/or any field lining access must be coordinated with the City of Arvada prior to rental approval. This includes duct tape for lines on fields. 20. Mowing or striping lines in parks and on ball fields is prohibited. 21. City parks and facilities are patrolled by local law enforcement agencies. All applicable City ordinances rules and regulations, to include state statutes and , will be enforced. 22. The City and its employees will not discriminate based on race, color, religion, national origin, gender, age, veteran status, or disability. The City of Arvada prohibits discrimination based on disability of any individual or group permitted to use City facilities or properties. This City recognizes and endorses the Americans with Disabilities Act (ADA). 23. The temporary installation of inflatables within specific parks requires express written permission from the City and a Certificate of Insurance from the Vendor that names the City as an additional insured 24. Permittee must provide group insurance, listing the City of Arvada as additionally insured on the plan, for $1 million USD. Permittee must submit a copy of the certificate of insurance along with this form to Stella Bickford 26. During the time the field and spectator area are being used by the Permittee, the Permittee is ---PAGE BREAK--- responsible for all accidents, injuries, field damages, or loss of property. Permittee shall indemnify, defend, and hold harmless the City of Arvada, its employees, agents and assignees, against any and all costs, expenses, claims, damages, liabilities, court awards, and other amounts (including attorneys’ fees and related costs) arising from or related to any act or omission by Permittee, or its employees, agents, subcontractors, or assignees in connection with the Agreement. 27. Late Booking Charges: ● Any field bookings requested within 3 business days of the event date will be charged an additional 25%. ● Any field bookings requested within 2 business days of the event date will be charged an additional 50%. ● Any field bookings requested within 1 business day of the event date will be charged an additional 75%. ● Any field bookings requested day of the event date will be charged an additional 100% if accommodations can be made. 28. Permittee understands that the City of Arvada may terminate this Agreement and revoke any permits issued for its sole convenience. If Arvada elects to terminate for convenience, such termination shall not be a breach of this Agreement. 29. Any violation of this field use agreement will be deemed a breach of this Agreement. T3 field givebacks submitted after the 7-day window will be charged 25% of initial requested use and released from that group. Field givebacks are due 30 days prior to use for Tier 1 (T1) and Tier 2 (T2) fields. Field cancellations made after the 30-day period will not be eligible for refunds. Should the City of Arvada dictate a field closure, City staff will notify groups with a reasonable amount of time prior to use. The City will work with permitted user(s) on possible reschedule dates. If a reschedule date cannot be found, a full refund for the missed practice or game will be administered. 2. Should a user group arrive at a field and the above listed conditions exist, or the conditions change or worsen, the user should cancel and will have one business day to notify The City via Email, at [EMAIL REDACTED] with a subject line of FIELD CANCELLATION DUE TO WEATHER, of their onsite cancellation. The City and the user groups will work together first to reschedule the missed use, and if a reschedule is not possible, The City will refund the use for a full practice or game. Partial refunds are not available. ---PAGE BREAK--- Athletic Field Rental Guidelines Cancellation Policy for Tournaments Field givebacks or changes are due 30 days prior to tournament start for refund, minus the non-refundable deposit. Field givebacks made after the 30-day period will not be refunded. The City of Arvada reserves the right to cancel historic use status if a tournament group cancels a tournament once permitted. Please see the table below outlining the City’s tournament cancellation policy. Tasks for multipurpose tournaments not using current season layouts Timeline/Due Date Site Visit: Permittee needs to set up a site visit with the Athletic Field Programming Department 29 days prior to first use Site Map, Field Layout, Field Diagrams submitted to Athletic Field Programming Department by Permittee 15 days prior to first use Athletic Field Programming Supervisor Communication to Permittee regarding Site Map, Field Layouts. Field lining and site maps finalized. 12 days prior to first use Tasks for all tournaments Timeline/Due Date Permittee Submit Tournament Grid/Game Schedule to the Athletic Field Programming Department 8 days prior to first use Permittee Submit on-site contact numbers to Athletic Field Programming Department (if applicable) 4 days prior to first use Athletic Field Programming Department sends Tournament Summary to Permittee 3 days prior to first use Athletic Field Programming Department sends Tournament Review form via Google Form 1 day after last use ---PAGE BREAK--- Updated 2023 In the case of unusable conditions, athletic fields will be closed. Unusable playing conditions: ● Standing water in goal mouths, midfields, or any other playing surface ● When frost exists ● Snow covered ● Where grass is sparse or field is worn badly and ground is saturated If at any time conditions exist that indicate that field damage will occur, games will be postponed. Athletic Field Rental Guidelines ATHLETIC FIELD WEATHER POLICY • No Snow Removal will be performed or permitted at any time on any athletic field. • No motorized vehicles (other than motorized wheelchairs) will be allowed on any field or park under any conditions. Field Status Updates: Field status will be updated by 1 p.m. on the City of Arvada’s CivicRec Site . Access the Field Status section by selecting the red ‘Athletic Field Status Tab.’ Designate a point-of-contact: There will be one primary contact for communications between the Permittee and the City of Arvada Parks Department. All communications will be channeled through these two representatives. A backup person or persons will be identified when the primary representative is unavailable. If the Permittee’s primary contact in charge has concerns that games should not be played, then they must contact the Parks Department and explain the condition or weather causing the concern. The Parks Department will make a decision after consulting with the primary contact. . The City of Arvada Parks Department has the ultimate authority to close the fields if necessary at any time due to weather conditions, unforeseen maintenance situations, or for the safety of its participants. Damages: Permittee may be held liable for damages to Park property, including infields, turf, and irrigation systems, if fields are damaged from use. Use of the fields after a declared closure is a violation of ---PAGE BREAK--- the Permittee’s obligations. Such violations may result in the permit being suspended or terminated.
