City of Anaheim COUNCIL POLICY Subject: Permit Parking Policy # 5.7 Adopted Date: 8/7/07 Amended: Page of It is the policy of the City Council that when spillover parking issues are identified in a neighborhood as a result of vehicles parking in a neighborhood when vehicle occupants have no destination in that neighborhood, that neighborhood residents will assist in identifying solutions. Permit parking will be a solution of last resort, and will be considered only after other options have been evaluated and determined to be infeasible. Neighborhood Services District Teams will facilitate neighborhood involvement through the following steps: 1. Anaheim Traffic and Transportation Manager receives a written petition signed by residents or merchants representing a minimum of five units in the identified area defining a parking problem in terms of times, locations and source(s) of spillover parking. 2. Traffic and Transportation Manager sends a letter to potentially affected residents, merchants, stakeholders and owners to request their participation at a meeting scheduled to refine the parking problem definition. If significant support is shown, the process continues to step 3. 3. Police Department performs field evaluation to determine whether 75% or more of street parking spaces are used on one or more street segment(s). 4. Code Enforcement staff reviews parking facilities at properties identified as generating spillover parking. 5. Neighborhood Services District Team reviews and discusses Police and Code Enforcement findings and meets with property management/owners of properties identified as generating the spill-over parking demand. Alternative solutions to parking problems are discussed with neighborhood, exploring opportunities to decrease parking demand and increase parking supply. 6. Where appropriate, alternative solutions are implemented. For example, increased enforcement of 72-hour parking limitation and/or Code Enforcement issuance of letters to advise landlords and tenants that no additional payment is allowed for code-required parking; individual multi-family dwelling owners may request participation in a voluntary demolition program of stand-alone garages and replacement with assigned (potentially tandem) parking spaces. ---PAGE BREAK--- City of Anaheim COUNCIL POLICY Subject: Permit Parking Policy # 5.7 Page of 7. If no solution other than residential permit parking appears to be feasible, the Neighborhood Services District Team determines if Permit Parking request meets the program requirement of 75% on-street parking use on one or more street segment(s). If request does not meet program requirements, Neighborhood Services District Team representatives communicate findings to neighborhood and process terminates. If the request meets the program requirement, the process continues to Step 8. 8. Neighborhood Services District Team meets with potentially affected interests to discuss options with neighborhoods that meet the Permit Parking program requirement and identify appropriate Permit-Eligible Parking District boundary. 9. Neighborhood Services District Team incorporates input from affected interests and advises on implementation process. The first of two neighborhood surveys is mailed to residents and owners of the entire Permit-Eligible Parking District. If a minimum 30% response rate among single family homes is achieved and a simple majority of returned surveys favor a Permit-Eligible Parking District, the City Attorney’s Office prepares a resolution for City Council consideration to create a Permit-Eligible Parking District. 10. Upon City Council approval of the Permit-Eligible Parking District, individual street segments within the identified Permit-Eligible Parking District boundary may request implementation of permit parking. A second survey is mailed to residents and owners of the subject street to determine if residents of the subject street are in favor of implementing a Permit Parking District. If a minimum 30% response rate among single family homes is achieved and a two-thirds majority of returned surveys favor of implementing a Permit Parking District, the City Attorney’s Office prepares a resolution for City Council consideration to create a Permit Parking District. 11. Upon establishment of a Permit Parking District, residents and owners will be informed of the outcome, and permits will be processed as set forth in Section 14.32.450 of the Anaheim Municipal Code.
