City of Anaheim Public Utilities Version No. 1.5 Effective Date 07/01/2018 Feed-In-Tariff Guidelines Author: APU May 9, 2022 : 1:53 PM Page - 1 1.0 Background This Guideline defines the process and criteria for entities to sell power to ANAHEIM in compliance with the provisions of the Standard Form Feed-In Tariff Power Purchase Agreement (FIT) for Renewable Generation. This Guideline satisfies ANAHEIM’s obligations, as they exist, under California Public Utilities Code Sections 399.20 and 387.6 and may be amended or supplemented from time to time. 2.0 Applicability Under the FIT, ANAHEIM offers published rates and standard contract terms to customers selling generation from qualifying Eligible Renewable Energy Resources subject to the process and criteria defined in this Procedure. 3.0 Definitions For the sole purpose of this Guideline, the capitalized terms used shall have the specific meanings ascribed to them in this Section. 3.1 “ANAHEIM Distribution System” means the wires, transformers, and related equipment used by ANAHEIM to deliver electric power to its retail customers typically at sub-transmission level voltages and lower. 3.2 “Applicant” means the entity submitting the Feed-In Tariff Application. 3.3 “Application” means submission of ANAHEIM FIT Application Form and related required documentation to initiate the process of entering into a standard contract to sell energy from an eligible renewable facility to ANAHEIM via interconnection with ANAHEIM’s distribution system. 3.4 “CEC” means the California Energy Resources Conservation and Development Commission, also known as the California Energy Commission, or its successor agency. 3.5 “Contract Capacity” means the installed electrical capacity available upon Commercial Operation of the Facility in the amount shown in Exhibit A of the FIT. Contract Capacity is measured at the ANAHEIM revenue meter in accordance with Section 8.9 of the FIT at the Delivery Point and shall be the Facility’s output in kilowatts and any reporting rights associated with such. 3.6 “Commercial Operation” means the period of operation of the Facility once the Commercial Operation Date has occurred ---PAGE BREAK--- City of Anaheim Public Utilities Version No. 1.5 Effective Date 07/01/2018 Feed-In-Tariff Guidelines Author: APU May 9, 2022 : 1:53 PM Page - 2 3.7 “Commercial Operation Date” means the date the Facility has successfully completed a test period of 168 hours of continuous operation. During this test, the Facility must meet the following conditions: a) Comply with all applicable interconnection and system protection requirements, b) Demonstrate the capability of delivering the Contract Capacity at the Delivery Point on a reliable and continuous basis. c) Demonstrate that all Facility components operate and are available during the 168-hour period. 3.8 “CPUC” means the California Public Utilities Commission. 3.9 “Customer” means an existing ANAHEIM customer, or third parties who will become ANAHEIM customers upon interconnection to ANAHEIM’s Distribution System. 3.10 “Date & Timestamp” means the date and time assigned to an Application upon receipt by ANAHEIM. The ANAHEIM 8th Floor Receptionist will Date and Time Stamp the Application Documents in the order they are received. 3.11 “Delivery Point” means the point of interconnection to ANAHEIM’s distribution system where ANAHEIM accepts title to the Facility power. 3.12 “Eligible Renewable Energy Resource” means a generating resource that has been certified as such by the CEC under California Public Utilities Code Section 399.12 and California Public Resources Code Section 25741, as either code may be amended or supplemented from time to time. 3.13 “Facility” means the specific Eligible Renewable Energy Resource as proposed by Applicant on ANAHEIM FIT Application Form. 3.14 “Facility Capacity” means the maximum potential amount of electricity that a Facility can produce, measured at the delivery point, measured in kilowatts or Megawatts (AC). 3.15 “Feed-In Tariff Available Capacity” means the amount of rated capacity that ANAHEIM will sign up under the Fee-In-Tariff program, as initially set at 8 MW AC by the ANAHEIM City Council, and as may be revised from time to time, in accordance with the Feed-In Tariff itself. 3.16 “Green Attributes” means those environmental attributes and credits as defined in the FIT that shall be provided to ANAHEIM from any Feed-In Tariff Facility that is an Eligible Renewable Energy Resource. ---PAGE BREAK--- City of Anaheim Public Utilities Version No. 1.5 Effective Date 07/01/2018 Feed-In-Tariff Guidelines Author: APU May 9, 2022 : 1:53 PM Page - 3 3.17 “Host Customer” means the ANAHEIM customer at whose locale the Facility is sited. 3.18 “Queue” means an ordered list of Applications which reside in the FIT Queue. 3.19 “Reservation Deposit” means the monetary payment made by an Applicant to secure a Reserved Position. 3.20 “Reserved Position” means an allotted share of the Feed-In Tariff Available Capacity. An Applicant must comply with the requirements of these Procedures and the requirements of the Power Purchase Agreement, to maintain their Reserved Position. The Reserved Position will be indicated in the FIT Queue as “Application Accepted, Feasibility Study in Progress, Contract Issued, Contract Executed or Operational.” 3.21 “Scheduled Commercial Operation Date” means the planned Commercial Operation Date of the Facility declared by Applicant. 4.0 General Rules, Rights And Obligations 4.1 Arrangement for other services. A Facility requiring other electric services from ANAHEIM including, but not limited to, Distribution Service during periods of curtailment or interruption of its Facility, must sign separate agreements with ANAHEIM for such services, in accordance with ANAHEIM’s approved Rates, Rules and Regulations and tariffs governing service. 4.2 Compliance with laws, rules, and tariffs. An Applicant shall comply with applicable ANAHEIM City Council approved tariffs; applicable Federal Energy Regulatory Commission-approved rules, tariffs, and regulations; and any local, state or federal law, statute or regulation which applies to the Facility, including its design, siting, construction, installation and operation. 4.3 Interconnection. Facility interconnection on ANAHEIM’s system will fully comply with Interconnection Guidelines. These guidelines conform to ANAHEIM’S Rates, Rules and Regulations. 4.4 Costs. All upfront or ongoing costs resulting from such interconnection shall be the responsibility of the Customer as described in ANAHEIM Rates, Rules and Regulations. ---PAGE BREAK--- City of Anaheim Public Utilities Version No. 1.5 Effective Date 07/01/2018 Feed-In-Tariff Guidelines Author: APU May 9, 2022 : 1:53 PM Page - 4 5.0 Application Process The following procedure will be observed to manage the Feed-In Tariff application process. Forms are available at http://www.anaheim.net 5.1 Applicant submits Application Package. The following materials must be submitted as an Application Package: a) Completed and signed Feed-in Tariff Application Form); b) Reservation Deposit calculated as the product of $20/kW times the proposed Facility Capacity. c) A Single-line drawing showing the electrical relationship and descriptions of the significant electrical components such as the primary switchgear, secondary switchgear, protective relays, transformers, generators, and circuit breakers. The single line diagram shall include operating voltages, capacities, and protective functions of the Generating Facility, the Customer's loads, and the interconnection with ANAHEIM's Distribution System. d) Site plans and diagrams showing the physical relationship of the significant electrical components of the Generating Facility such as generators, transformers, primary switchgear/secondary switchgear, and control panels, the Customer's loads and the interconnection with ANAHEIM's Distribution System. e) If transformers are used to interconnect the Generating Facility with ANAHEIM's Distribution System, please provide transformer nameplate information (voltages, capacity, winding arrangements, connections, impedance, etc.) f) If a transfer switch or scheme is used to interconnect the Generating Facility with ANAHEIM's Distribution System, please provide component descriptions, capacity ratings, and a technical description of how the transfer scheme is intended to operate. g) If protective relays are used to control the interconnection, please provide protection diagrams or elementary drawings showing relay wiring and connections, proposed relay settings, and a description of how the protection scheme is intended to function. Each of the documents listed above are required to be submitted. Drawings must conform to accepted engineering standards and must be legible; 11"x17" drawings are preferred. 5.2 ANAHEIM review of Application. ANAHEIM will assign a Date and Time Stamp to each Application upon receipt. If ANAHEIM determines that the Application is complete, ANAHEIM will then assign the Application to FIT Queue. Incomplete Applications will be returned to the Applicant with their Reservation Deposit. Any complete Applications exceeding the Feed-In Tariff Available Capacity will be will also be returned together with the associated Reservation Deposit. 5.3 ANAHEIM reply with confirmation that the FIT Application has been accepted. ANAHEIM will indicate by electronic written reply to Applicant whether the Application has been accepted or rejected. If the application has been accepted the Applicant will also be given a FIT Record Number as confirmation of acceptance in the FIT program. The FIT Record Number will also identify the position of the Applicant in the FIT Queue. 5.4 ANAHEIM Interconnection review. ANAHEIM performs initial and supplemental reviews of the proposed interconnection to verify interconnection availability; and develops preliminary cost estimates and interconnection requirements. ANAHEIM reserves the right to modify the interconnection review timeline at anytime. 5.5 Line-work and “Meter & Service” Work. Because generators under the Feed-In Tariff are not interconnected behind an existing meter as are net-metered systems, all interconnections will require, at a minimum, “Meter & Service” work. In addition, distribution line extensions to the metering location and system reinforcements may be required, and are billable to the customer. This work will be designed and constructed by ANAHEIM, and may require the customer to install civil infrastructure at their cost to accommodate such extensions. All ANAHEIM design and construction costs associated with the interconnection are billable to the customer. 5.6 Preparation of Final Agreements. ANAHEIM requests detailed project information from Applicant in order to complete Standard Form FIT Power Purchase Agreement and Interconnection Agreement for a given FIT Application. Should Applicant not respond and provide the requested data in a timely manner, ANAHEIM will send Applicant a written notice of deficiency, giving Applicant 10 days in which to provide this information or lose its FIT Queue Position. In such case, 100% of the Reservation Deposit will be returned to the Applicant. 5.7 Presentation of Agreements. ANAHEIM presents Applicant with the Standard Form FIT Power Purchase Agreement and the Standard Form FIT Interconnection Agreement. ANAHEIM will prepare and issue executable copies of the Standard Form FIT Power Purchase Agreement and Standard Form FIT Interconnection Agreement. 5.8 Applicant returns executed agreements. Applicant has 30 days to return all information required in this step, or it will lose its FIT Queue position and 100% of the Reservation Deposit will be returned to Applicant. ---PAGE BREAK--- City of Anaheim Public Utilities Version No. 1.5 Effective Date 07/01/2018 Feed-In-Tariff Guidelines Author: APU May 9, 2022 : 1:53 PM Page - 6 h) Return the executed Standard Form FIT Power Purchase Agreement. i) Return the executed Standard Form FIT Interconnection Agreement. j) Include a check for the full amount of the estimated interconnection costs. k) Provide evidence of site control, such as a letter of intent from property owner(s), lease agreement(s), title documents, etc. 5.9 ANAHEIM executes Agreements. ANAHEIM will perform a final review of returned agreements and the evidence of site control, and will deposit the funds for the estimated interconnection costs. ANAHEIM, once approved by the City Council, will then execute the Agreements, and confirm to Applicant via written notification the acceptance of completed agreements. 5.10 Work proceeds on Facility. Applicant proceeds with development and construction of Facility. ANAHEIM coordinates and completes interconnection facilities. 5.11 Facility achieves Commercial Operation. Commercial Operations begin in accordance with the terms of the Power Purchase Agreement. 5.12 Payments. ANAHEIM’s Energy Settlements Division will process billing and payments for energy purchased by ANAHEIM under the Power Purchase Agreement. ANAHEIM’s Customer Services will manage billing and payments on the Customer’s retail account. 6.0 Feed-In Tariff Available Capacity The combined total of reserved and installed Facility Capacity under the FIT cannot exceed the Feed-In Tariff Available Capacity. 6.1 The capacity of any individual Facility cannot exceed 3,000 kW (AC) as measured at the proposed Delivery Point. 6.2 The minimum Facility size for Feed-In Tariff eligibility is 100 kW (AC). ---PAGE BREAK--- City of Anaheim Public Utilities Version No. 1.5 Effective Date 07/01/2018 Feed-In-Tariff Guidelines Author: APU May 9, 2022 : 1:53 PM Page - 7 7.0 Eligibility Requirements 7.1 A Facility must be an Eligible Renewable Energy Resource, selling one hundred percent (100%) of its energy output and Green Attributes associated with that energy, under contract to ANAHEIM. 7.2 The Facility must be connected to the ANAHEIM Distribution System. 7.3 Facilities taking service under the Feed-In Tariff may not also obtain benefits from any of the following for the same Facility: a) A bilaterally negotiated Standard Form FIT Power Purchase Agreement with ANAHEIM for deliveries of additional power; b) Incentives from ANAHEIM under customer programs implemented in compliance with SB 1 requirements or similar program; or c) If the Facility is an Eligible Renewable Energy Resource, use of the net metering option for energy deliveries in excess of Host Customer load. 8.0 Reservation Deposit Applicants must submit a Feed-In Tariff Reservation Deposit along with their Feed-In Tariff Application. The deposit shall equal the proposed Facility Capacity, as measured at the Delivery Point, times the Reservation Deposit rate of $20/kW. 8.1 Applications made without the Reservation Deposit will be rejected. 8.2 At the time of determining the completeness of an Application, ANAHEIM will assume that any check made for payment of the Reservation Deposit will be honored by Applicant’s financial institution and that Applicant has sufficient funds to cover the check. 8.3 Should Applicant’s check be returned for insufficient funds, ANAHEIM will release the Applicant from the FIT Queue and deem that the Application is rejected. The Applicant will lose any queue status and will have to resubmit the Application in its entirety. 8.4 Should project be rejected or terminated any time before Standard Form FIT Power Purchase Agreement is executed, 100% of the Reservation Deposit shall be returned to Applicant. 9.0 Reservation Queue Management ---PAGE BREAK--- City of Anaheim Public Utilities Version No. 1.5 Effective Date 07/01/2018 Feed-In-Tariff Guidelines Author: APU May 9, 2022 : 1:53 PM Page - 8 ANAHEIM will maintain a Reservation Queue for Feed-In Tariff Applications in order to establish both Reserved Positions. 9.1 ANAHEIM will assign Reserved Positions to Complete Applications on a first-come-first-served basis until maximum available capacity has been met. 9.2 Receipt of Application. When delivered to the ANAHEIM West Tower, 8th Floor Reception area, Applications will be time-stamped in the order in which Applications were received by ANAHEIM. a) ANAHEIM cannot guarantee the rank ordering of Applications delivered via US Postal Service or by overnight or air express. b) Should Applicant wish to ensure a timely rank ordering, ANAHEIM recommends that Applicant hand deliver the Application to the ANAHEIM West Tower. c) Within ten (10) days of receipt, ANAHEIM will post a copy of Applicant’s request on its Internet Web site located at: http://www.anaheim.net d) Such information shall be provided pursuant to Public Utilities Code (PUC) §399.32(i), and shall not include proprietary or confidential Customer or Facility information. 9.3 Queue information will be posted on ANAHEIM’s website at http://www.anaheim.net/utilities/FIT/Queue_Management. Each Facility will be given a FIT Queue ID and status code. Status codes will be as follows: e) Application Accepted. An initial determination by ANAHEIM that Applicant has provided all required documents, information and funds. f) Feasibility Study in Progress. An indication that ANAHEIM is conducting the Feasibility Study for the Facility. g) Withdrawn. An indication that Applicant has withdrawn its Application. h) Contract Issued. An indication that ANAHEIM has issued a Standard Form FIT Power Purchase Agreement and an Interconnection Agreement to Applicant. i) Contract Executed. An indication that Applicant has returned executed contracts to ANAHEIM, along with all required information and funds, and that ANAHEIM has executed the contracts. ---PAGE BREAK--- City of Anaheim Public Utilities Version No. 1.5 Effective Date 07/01/2018 Feed-In-Tariff Guidelines Author: APU May 9, 2022 : 1:53 PM Page - 9 j) Terminated. An indication that the Reserved Position for Applicant has been terminated, either from failure to return executed contracts in a timely manner, or because the FIT was terminated under its own terms. k) Operational. An indication that the Facility has achieved Commercial Operation. 10.0 Posting of Queue Information ANAHEIM will post Queue information on its website, www.Anaheim.net. Once an Application that has been submitted is complete and is deemed Accepted by ANAHEIM, information on that Application shall be made available, along with the information of other Applications, in the Queue. Note that irrespective of the confidentiality language in ANAHEIM’s Feed-In-Tariff Agreement or Interconnection Agreement, the following Application information will be made available to the public on the posting: 10.1 FIT Record Number. (Date + Time + Seq Number) (mm-dd-yy-hh-###) 10.2 Application received date. 10.3 Facility capacity. 10.4 Application status. 10.5 Technology Type 10.6 Contract Term 11.0 Power Purchase Agreement Applicants that are assigned Reserved Positions will be offered the Standard Form FIT Power Purchase Agreement and FIT Interconnection Agreement that will require execution with ANAHEIM in order for sales to ANAHEIM under the Feed-In Tariff to take place. 11.1 Eligible contract terms are available for 10, 15, or 20 years at the Facility Owner’s option. 11.2 The Standard Form FIT Power Purchase Agreement terms and conditions will reflect this Procedure in effect at the time of execution of the Power Purchase Agreement. Should this Procedure be revised following execution of a Power Purchase Agreement, the terms of the Standard Form FIT Standard Form FIT Power Purchase Agreement shall prevail in the event of any conflict 11.3 The Standard Form FIT Power Purchase Agreement will conform at all times to ANAHEIM’s Rates, Rules and Regulations, as amended from time to time. Any changes to ANAHEIM’s ---PAGE BREAK--- City of Anaheim Public Utilities Version No. 1.5 Effective Date 07/01/2018 Feed-In-Tariff Guidelines Author: APU May 9, 2022 : 1:53 PM Page - 10 Rates, Rules and Regulations which would act to modify this Agreement shall automatically be incorporated herein without need for a formal amendment. 11.4 A Facility shall be no larger than 3,000 kW AC. Under the FIT, an Eligible Renewable Energy Resource must sell to ANAHEIM all energy output and Green Attributes associated with that energy. 11.5 Should an Applicant propose a Facility configuration or deal structure requiring negotiation of the Standard Form FIT Standard Form FIT Power Purchase Agreement terms and conditions that are different than those included in the standard form Power Purchase Agreement, ANAHEIM will reject the Application. 12.0 Commercial Operation Date Applicant must specify the Scheduled Commercial Operation Date at the time the Application is submitted. The Scheduled Commercial Operation Date must meet the following criteria: 12.1 The Scheduled Commercial Operation Date proposed by Applicant must fall within the date range bounded by the published FIT Rates at the time the Application is submitted. 12.2 ANAHEIM will allow Applicant to modify its project’s Scheduled Commercial Operation Date prior to execution of the Standard Form FIT Power Purchase Agreement to accommodate reasonable changes in the factors affecting when a project can be brought on line. 12.3 Applicants may petition ANAHEIM and request a change, so long as the revised Scheduled Commercial Operation Date remains within the period covered by then current published Feed-In Tariff rates. 12.4 Acceptance of any change in the Scheduled Commercial Operation Date is upon ANAHEIM’s approval. 12.5 If a Standard Form FIT Power Purchase Agreement is executed between ANAHEIM and Applicant, under the terms of the Power Purchase Agreement, the Scheduled Commercial Operation Date can be modified once. 12.6 Applicant must provide notice of the revised Scheduled Commercial Operation Date at least 90 days prior to the initial Scheduled Commercial Operation Date. 12.7 The revised Scheduled Commercial Operation Date cannot be earlier than January 1 of the same calendar year as the initial Scheduled Commercial Operation Date. ---PAGE BREAK--- City of Anaheim Public Utilities Version No. 1.5 Effective Date 07/01/2018 Feed-In-Tariff Guidelines Author: APU May 9, 2022 : 1:53 PM Page - 11 12.8 The revised Scheduled Commercial Operation Date cannot be later than 90 days after the initial Scheduled Commercial Operation Date. 12.9 Under the terms of the Standard Form FIT Power Purchase Agreement, ANAHEIM will terminate the Agreement if the Facility has not achieved Commercial Operation within ninety (90) days following the Scheduled Commercial Operation Date as revised. 12.10 Under the terms of the Standard Form FIT Power Purchase Agreement, the final Commercial Operation Date will be specified in a Commercial Operation Date Confirmation Letter which the Parties will execute and exchange. 13.0 Certification as Renewable To qualify for this Feed-In Tariff as an Eligible Renewable Energy Resource, the Facility shall obtain certification from the California Energy Commission as an Eligible Renewable Energy Resource prior to Commercial Operation, and shall maintain such certification throughout the term of the Power Purchase Agreement. 14.0 Pricing under the Feed-In Tariff The Feed-In Tariff prices will be posted on the ANAHEIM Web site http://www.anaheim.net/Utilities 14.1 The Annual Offer Price (“AOP”) shall be updated and become effective July 1 of each year. The AOP shall be calculated as follows based on the sum of the prior Calendar Year averages for the following rate components: AOP = Avoided Energy Charges + Avoided Transmission Charges + Renewable Energy Adder AOP Rate Component Calculation Avoided Energy Charges Utility’s annual weighted average cost of energy purchased from the California Independent System Operator (CAISO) at the Default Load Aggregation Point (DLAP) at the Southern California Edison service area, or its successor Avoided Transmission Charges Utility’s annual weighted average CAISO High Voltage Access Charge, or its successor Renewable Energy Adder Value of renewable energy credits based on the Utility’s most recently executed renewable power purchase contractual commitment of ten years or more The AOP determined by this calculation as well as the rate components shall be posted on the Utility’s website. ---PAGE BREAK--- City of Anaheim Public Utilities Version No. 1.5 Effective Date 07/01/2018 Feed-In-Tariff Guidelines Author: APU May 9, 2022 : 1:53 PM Page - 12 The AOP shall be multiplied by the applicable Time of Delivery Factor as reflected on the Utility’s website; the appropriate factor shall be determined based on the time which the Distributed Generator delivers energy to the Utility’s electric distribution system. 14.2 ANAHEIM reserves the right to change pricing development methodology as industry circumstances warrant. 15.0 Interconnection Feed-In Tariff interconnections and the interconnection review process for Feed-In Tariff Applications will be managed using this guideline process. 15.1 During the interconnection review process, ANAHEIM may determine that the Facility capacity proposed by Applicant is too large for the proposed interconnection location. In this event, ANAHEIM will allow Applicant to reduce the proposed Facility capacity to a size that can be accommodated at the proposed interconnection location. In addition, when distribution system improvements can reasonably be made which will increase ANAHEIM’s ability to receive capacity from the Applicant’s proposed location, the Applicant will have the option of proceeding at the proposed capacity while assuming the costs of these improvements. 15.2 In no event will ANAHEIM allow Applicant to increase the proposed Facility capacity of the Application. 15.3 The current Generation Interconnection Standards and Guidelines as referenced in the link below should be reviewed and followed by Applicant. The Generation Interconnection Standards and Guidelines may be subject to change without notice to reflect changes in industry standards and practices or Anaheim’s rates, rules and regulations. 16.0 Authorized ANAHEIM Representative Feed-In Tariff Applications must be addressed to the ANAHEIM Feed-In-Tariff Program Manager. The time and date stamp given by the 8th floor receptionist will be the official time and date of receipt of the Application by ANAHEIM.
