OHS West:260431863.3 CITY OF ANAHEIM COMMUNITY FACILITIES DISTRICT NO. 08-1 (PLATINUM TRIANGLE) Community Facilities District Proceedings and Special Tax Election (Mello-Roos Community Facilities Act) Election: July 24, 2008 Ballot Pamphlet And Instructions to Voter ---PAGE BREAK--- OHS West:260431863.3 Dear Voter: The City Council (the “City Council”) of the City of Anaheim (the “City”), acting ex officio as the Legislative Body (the “Legislative Body”) of City of Anaheim Community Facilities District No. 08-1 (Platinum Triangle) (the “District”), has called a special election to be held within the boundaries of the District on July 24, 2008, for the purpose of submitting the proposition to incur bonded indebtedness in a maximum amount of not to exceed $480,000,000, to levy a special tax within the District and to establish an appropriations limit for the District, as specified, respectively, in Resolution No. 2008-053, adopted by the Legislative Body on April 22, 2008, forming the District, and Resolution No. 2008-054, adopted by the Legislative Body on April 22, 2008, deeming it necessary to incur bonded indebtedness. This is a landowner election with the landowners of record within the District as of the close of the April 22, 2008 public hearings being entitled to cast one vote for each acre or portion thereof he or she owns within the District. The ballots are being mailed to the landowners listed on the latest equalized assessment roll prepared by the County of Orange Assessor, as updated by information known to the City and the District regarding ownership. YOU WILL RECEIVE ONE BALLOT FOR EACH GROUP OF PARCELS SHOWN ON THE ASSESSOR’S ROLL UNDER AN IDENTICAL NAME. THE BALLOT WILL BE SENT TO EACH ADDRESS SHOWN ON THE ASSESSOR’S ROLL; HOWEVER, ONLY ONE BALLOT WILL BE COUNTED FOR VOTING PURPOSES. Each qualified voter has been issued one ballot that entitles that voter to vote the number of votes allotted to his or her total acreage of land within the District. Each landowner is allotted one vote for each acre or portion of an acre of land that he or she owns within the District. The election will be conducted by mailed ballot. The City Clerk of the City will mail a ballot to each landowner. Ballots must be marked and returned to the City Clerk’s Office at 200 South Anaheim Boulevard, Anaheim, California 92805, not later than 8:00 p.m., July 24, 2008. Contained in this Ballot Pamphlet and Instructions to Voter are Instructions to Landowner Voter, a Sample Ballot and an Impartial Analysis of the proposition showing the effect of the proposition on the existing law and the operation of the proposition, prepared by the City Attorney’s Office. The number of votes to be voted pursuant to this ballot is INSTRUCTIONS TO VOTERS: To vote on the proposition, mark a cross or in the voting square after the word “YES” or after the word “NO.” All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly mark, tear, or deface this ballot, return it to the City Clerk of the City of Anaheim and obtain another. PROPOSITION A: Shall City of Anaheim Community Facilities District No. 08-1 (Platinum Triangle) be authorized to incur bonded indebtedness in a maximum amount of $480,000,000 and levy a special tax in accordance with a rate and method of apportionment in order to finance certain public facilities and shall an annual appropriations limit of $480,000,000 be established for the Community Facilities District, as specified in Resolution Nos. 2008-053 and 2008-054 adopted by the City Council of the City of Anaheim on April 22, 2008? Yes: No: ---PAGE BREAK--- OHS West:260431863.3 3 IMPARTIAL ANALYSIS FOR SPECIAL ELECTION FOR CITY OF ANAHEIM COMMUNITY FACILITIES DISTRICT NO. 08-1 (PLATINUM TRIANGLE) TO BE HELD JULY 24, 2008 The City Council of the City of Anaheim (the “City Council”), acting ex officio as the Legislative Body (the “Legislative Body”) of City of Anaheim Community Facilities District No. 08-1 (Platinum Triangle) (the “District”), on April 22, 2008, adopted Resolution No. 2008-055 calling a mailed-ballot election for July 24, 2008. The election is being called pursuant to Sections 53326 and 53327.5 of the California Government Code. The City initiated proceedings to establish the District, to levy a special tax on those properties within the District and to issue bonds in an amount not to exceed $480,000,000 to finance a portion of certain public facilities, including street improvements, including grading, paving, curbs and gutters, sidewalks, street signalization and signage, street lights and parkway and landscaping related thereto, sewers, storm drains, water facilities, electric utility facilities, fire facilities and equipment and land, rights-of-way and easements necessary for any of such facilities within the District. On April 22, 2008, the City Council adopted Resolution No. 2008- 053 establishing the District, approving the levy of a special tax, and setting an appropriations limit for the District. As required by law, the Legislative Body is submitting the question of whether a special tax shall be levied to the property owners subject to the levy. Proposition would authorize the Legislative Body of the District to issue bonds in an aggregate principal amount not to exceed $480,000,000 for the purposes of: funding and financing the public facilities; funding a reserve fund to pay debt service on the bonds; and funding costs associated with issuing the bonds. The bonds may not have a maximum term that exceeds 40 years and may not bear an interest rate that exceeds the maximum interest rate permitted by law. A “Yes” vote on Proposition is a vote: 1) to authorize the Legislative Body of the District to issue special tax obligation bonds in an aggregate principal amount not to exceed $480,000,000 for the purposes outlined above; 2) to authorize the levy of a special tax on non-exempt property within the District in accordance with the Rate and Method of Apportionment, which is attached to Resolution No. 2008-053; and 3) to establish an annual appropriations limit of $480,000,000 for the District. A “No” vote on Proposition is a vote: 1) against authorizing the Legislative Body of the District to issue the special tax bonds; 2) against the levy of the proposed special tax on property within the District; and 3) against the establishment of the proposed annual appropriations limit.
