CITY OF ALBANY LEASE OF MULTIFUNCTIONAL COPIERS AND MAINTENANCE SERVICES RFP 2019-31 ADDENDUM #2 CITY OF ALBANY ---PAGE BREAK--- LEASE OF MULTIFUNCTIONAL COPIERS AND MAINTENANCE SERVICES RFB 2019-31 ADDENDUM #2 OCTOBER 25, 2019 The following information is provided as a result of question(s) posed by vendor(s): QUESTION In regards to item 5.2, does the cancellation flexibility pertain to the umbrella contract which will result from the award or to the individual leases themselves? If the cancellation pertains to the individual leases themselves, is the County agreeable to having this flexibility only for uncured defaults within a reasonable period (i.e. 30 days) and for non- appropriation of funds? ANSWER It is the intent of the City Of Albany to use this particular clause to protect the City from an unresponsive vendor. Our intent, also the reason why we are avoiding third party leases, is to make sure that the vendor is maintaining their machines, providing customer service if there is a problem, and providing adequate equipment and/or products for each machine to preform smoothly. While the City Of Albany rarely cancels a contract, the above lists our reasonable expectations since some of our facilities run 24/7. Therefore all equipment must work efficiently without delays. If we were to cancel this contract, we would ask that ALL of the vendor’s equipment be removed from each facility and all leases be canceled. QUESTION Good morning, sorry I have to follow up on the question below. Your answer addresses third party leasing and not cancellation for convenience. We understand third party leasing is not acceptable but is it Albany’s intent to cancel the lease any time for any reason? If not, is it fair for bidders to assume the lease will go full term with no cancellation for convenience? ANSWER Please refer to answer
