USDO CLARIFICATION 061617.002 DATE: JUNE 16, 2017 FROM: CHRIS SPENCER, DIRECTOR OF PLANNING ACTION: CONSIDER FUTURE CODE AMENDMENT (A002) ISSUE The front set back for the R-V is listed in two separate tables of the USDO. The tables are not consistent and provide different minimum front setbacks. The front setback in the R-V is listed as 10 ft. in Table 375-2-43 (R-V Residential Village) and as 20 ft. in Table 375-4-1 (Residential District Dimensional Standards) The purpose of this memo is to clarify the front setback and make a recommendations for modifications to the USDO for the six month review. INTERPRETATION The intent for the R-V district was to have the setbacks meet those of the RMV Overlay that was being considered so that when the USDO went into effect, the overlay would dissolve with the dimensional and other standards left unchanged. This was communicated to the consultant, however, it appears that there was a drafting error in Table 375-4-1. Therefore, the minimum front setbacks that shall be required in the R-V will be that listed in Table 375-2-43, which is 10 ft. SIX MONTH REVIEW RECOMMENDATIONS 1. Modify table 375-4-1 to indicate minimum front setback in the R-V of 10 ft. 2 0 0 H E N R Y J O H N S O N B O U L E V A R D I A L B A N Y , N E W Y O R K 1 2 2 1 0 I 5 1 8 . 4 3 4 . 5 2 6 2 C I T Y O F A L B A N Y N E W Y O R K DEPARTMENT OF PLANNING AND DEVELOPMENT MAYOR: KATHY M.
