Related to the Outbreak of COVID-I9 L Kathy Sheehan, Mayor, of the City of Albany New York, in accordance with a Proclamation of State of Emergency executed on the l5th day of March 2020, ar,id thereafter renewed, do hereby declare that, effective immediately, Albany City Code $375-3(CX6)(l), related to the regulation of sidewalk or outdoor cafds, notwithstanding sections (ii), (iii) and H, is hereby suspended for those legally operating restaurants, bars, or taverns which seek to expand the availability of outdoor serving space pursuant to NYS Governor Cuomo's amouncement and order that limited commercial outdoor dining may resume as part of Phase II of the Capital Region's Covid-l9 related reopening beginning June 4, 2020. Each business operating within outdoor space on publie property must maintain four feet clear along the sidewalk foq pedestrian passage. After close and deliberate consultation with City staffand members of the community, I have determined that this action is essential to the City of Albany's ability to cope with and recover from the unprecedented public health emergency presented by the Covid-l9 pandemic. Pursuant to Executive Law 24(1XGXi), this order shall remain in effect for five days or until it is rescinded by me.
